CLASSIFICATION: 条款1. 分类 The EMPLOYEE will work as a/an/the____ Algeria Project ______for the EMPLOYER for its engineering projects in Algeria and complete the production task assigned by the EMPLOYER on time as per the work quota, task, safety and quality requirements determined by the EMPLOYER. At times if work offered is not available in any one section, the EMPLOYEE should do the other related work as requested or required. The EMPLOYEE should not work or engage for wage or salary for any other(s) during the entire term of this employment. 雇工将以阿尔及利亚项目身份为雇主在阿尔及利亚的工程工作并按时完成雇主指定的任务,并依照雇主决定的工作量,任务,安全和质量要求。任何时候工作的任何一方面不可行,雇工必须按要求和需要做其它相关的工作。雇工在雇佣的全程不能为其他人工作并索取工资。 CLAUSE 2. LOCATION OF WORK 条款2 工作地点 The location of work is in Algeria and will be transferable within the country of Algeria to other job sites whenever necessary. 工作地点在阿尔及利亚并且可以随时转移到阿尔及利亚的其他工地。 CLAUSE 3. PERIOD OF EMPLOYMENT 条款3 雇佣时间 3.1 The period of employment is 24 months effective from the day he arrives at the project site, including a probation period of 90 days, which could be shortened or extended by the EMPLOYER free from breaching of this contract if project progress was affected by reasons of force majeure, objectiveness or weather. For this reason, the EMPLOYEE should be informed by the EMPLOYER fifteen days in advance. 3.1 雇佣时间为24个月,包括试用期90天,从工人离开越南到达工地生效。试用期只有在工程由于不可抗力,客观原因或者天气影响进度的情况下,才可以由雇主自由的违背这份合同进行缩短或者延长。 3.2 If the EMPLOYEE is not competent for his job or disobeys the EMPLOYER’s management at construction site during the probationary period, the employment should be terminated. And also the EMPLOYEE will have to bear all cost to return home. 如果在试用期内雇工不能胜任其工作,或者在工地不遵守雇主的安排,雇佣关系将被终止。雇工将承担自己回国的费用。 3.3 This contract of employment should be deemed to be terminated starting from the day the EMPLOYEE leaves Algeria project site. 3.3 在雇工离开阿尔及利亚项目现场之日,该合同关系将被认为终止。 3.4 For the requirement of production (work), this contract of employment may be renewed through mutual consent of both parties after its expiry. 3.4 为了生产需要, 雇佣合同在到期之后, 可由双方同意并续签。 3.5The Employer will provide with economy class air tickets Hanoi-Algeria and Algeria- Hanoi after completion of 2 years contract. 3.5雇主提供河内 –阿尔及利亚以及 工人期满回国的来回经济舱机票。 CLAUSE 4. WORK TIME, REST AND VOCATION 条款4 工作时间,休息和假期 4.1 The EMPLOYER will work for 26 days a month and 10 hours per day, as per the requirement of the project progress or seasons. “The Employer” has the right to adjust the 4 rest days of every month according to the project progress or seasons on condition of ensuring the total time of rest days in one year of the Employee and if the rest days are insufficient, they will be regarded as overtime work. 4.1 雇工将一个月工作26天,每天工作10小时,依照雇主因工程进度或者季节原因的要求。每月的四个休息日雇主可根据工程进度及天气状况进行调整,前提保证雇工在一年内的休息天数,休息天数不足部分按加班处理。 4.2 The EMPLOYER could ask the EMPLOYEE to work overtime as per construction requirement, and the time exceeding 10 hours of work per day will be paid as per the standard specified at Clause5.6. 4.2 雇主可因施工的要求安排雇工加班,时间超过10小时每天的时候将按照条款5.6 的 标准 excel标准偏差excel标准偏差函数exl标准差函数国标检验抽样标准表免费下载红头文件格式标准下载 进行支付。 4.3 The EMPLOYEE could enjoy 7days Vietnam National Legal Holidays each year, i.e., three days for Lunar spring festival, one day for National Labor’s Day, one day for New Year’s Day on Jan.01, one day for Vietnam National Day on Sept.02, and one day for Unity Day on Apr.30. 4.3雇工每年可以享受越南法定的7天节假日,三天是阴历的春节,一天是国家劳动节,一天是1月1日的新年,一天是9月2日的越南国庆节,一天是4月30日的团结日。 4.4 Upon completion of each first two years of work, the EMPLOYER will be given 21 days (unpaid) as vacation leave if further employment is required. A free economy class round-trip ticket of Vietnam--Algeria will be provided by the EMPLOYER. 4.4 雇工每满两年的工作,雇主如果需要继续雇佣的话,将给雇工21天(无工资)的假期休假。雇工往返于越南和阿尔及利亚的经济舱机票由雇主承担。 4.5 During work period, the EMPLOYER should assist the EMPLOYEE for medical treatment if he is unable to work normally because of illness. Sick leave is approved as per the certificate from medical practitioner and the EMPLOYEE should be paid for his service period as per the following payment manner: 4.5 在工作期间,如果雇工因病不能正常的工作,雇主将帮助雇工进行医疗救治。将依照医师的鉴定认定其是否因病休假的批准,并且雇工将依照以下支付方式支付他的服务期: First Fifteen days 第一个15天: US$10/day 10美元每天. After fifteen days 之后的15天: No pay 不支付 If the EMPLOYEE could not recovered from sickness after expiration of 30 days of sick leave entitled to him, the employment should be deemed to be terminated. The cost of the return air transportation to the EMPLOYEE’s point of origin should be borne by the EMPLOYEE. 如果雇工在授予他的疾病休假满30天后没有康复,雇佣合同被认为结束。雇工回程的机票将由雇工自己承担。 CLAUSE 5. WAGES 条款5 工资 5.1 As per project progress or seasons changing, the EMPLOYER will pay 580 USD / month (remuneration will be different according to work category) basic salary for 10 hours/day, 6 days/week, which includes basic salary and all other incomes. For the first 03 months of work, the EMPLOYER will keep US$200/month as deposit and this sum of US$600/- will be paid off when the Employee finishes his employment contract and return back to Vietnam. 5.1依照工程进度和季节变化,雇主将为其每天工作10小时,每星期6天而,支付580(根据工种不同数额不同)美元/每月的基本工资,580(根据工种不同数额不同)美元包括了基本工资等一切收入。前三个月的工作,雇主将保存200美元每月每个劳工,作为保证金,保证金总额为600美元,将在雇工完成他们的雇佣合同回越南的时候付清。 5.2 After probation period of 90 days, within the specified working time, the EMPLOYEE has to finish the work quota specified by the EMPLOYER, failing which, the EMPLOYER is entitled to decrease the lump-sum Salary of the EMPLOYEE. 5.2 在试用期满90天的时候,以实际情况符合雇工工作效率,在规定的时间内,雇工需完成雇主规定的工作量,如果没有完成,雇主有权降低雇工工资总额。 5.3 Under the mature production conditions, the EMPLOYER could adopt the piecework compensation system, for which, the EMPLOYEE should be informed of the piece rate which should be justice and equity. 5.3 在成熟的生产环境中,雇主应可以接受计件薪酬体系,雇工的计件工资率必须是公平公正. 5.4 At any time, if the EMPLOYEE is absent from work without consent of the EMPLOYER (e.g. absence, personal reasons, work strike, suspension from work on disciplinary grounds), a penalty of double salary will be applied for each abuse. If the absent from work for no reason for 2 consecutive days or 4 days within contract period, the employee will be dismissed and be borne the expenses of return home by himself. 5.4 在任何情况下,雇工在没有雇主的同意下缺勤(例如:缺勤,个人原因,罢工,因纪律处分原因停工),双倍工资的罚金将适用于每一种恶行。那些无故缺勤工作连续两天或合同期内4天的雇工,将被解雇,并自行承担回程费用。 5.5 However if the work is not offered or is suspended due to the EMPLOYER’S reasons, the EMPLOYEE will be compensated for US$10/day. 5.5 因雇主原因没有提供工作或者暂停工作,雇工将给10美元每天的报酬。 5.6 If the EMPLOYEE’s daily work exceeds the working time specified by Clause 4.1, he will be paid1.5 times as much. If the EMPLOYEE works on the 7 days Vietnam National Legal Holidays, he will be paid 2.0 times as much. 5.6 如果雇工的日常工作超过条款4.1规定的工作时间,将付1.5倍工资,如在约定越南7天法定节假日加班将付2倍工资。 5.7 Salary should be paid monthly before 20th of the following month by remitting to specified Vinaconexmec’s Bank A/C entrusted by the EMPLOYER. After the EMPLOYER’s remitting the salary of the EMPLOYEE to the specified Vinaconexmec’s Bank A/C entrusted by the EMPLOYEE, the EMPLOYER should not take any responsibilities whether the salary is paid to the EMPLOYEE or not by the Vinaconexmec. 5.7 工资月付,在下一个月20日前汇入雇工指定授权的越南劳务公司的往来账户.雇主将工资汇入雇工指定授权的越南劳务公司的往来账户后,如发生工资发放不到及其它情况与雇主不再相关,雇主不在因此承担其它任何责任。 CLAUSE 6. HAND TOOLS AND SAFETY EQUIPMENT 条款6 手动工具和安全装备 6.1 The EMPLOYER should provide the EMPLOYEE with working condition and hand tools required for his job. 6.1雇主提供雇工工作环境和与其职业工作相关的工具。 6.2 The EMPLOYEE should return all hand tools furnished by the EMPLOYER upon termination of the employment. In case of the EMPLOYEE failing to return any of the hand tools furnished by the EMPLOYER, the EMPLOYER will deduct the cost of the tool(s) from any payment due to the EMPLOYEE. 6.2 雇工在雇佣关系结束之后要归还所有的提供的手动工具,如果雇工不能归还任何雇主提供的手动工具,雇主可以在给雇工的任何付款中扣除工具的钱。 6.3 The EMPLOYEE should abide by all the safety operation regulations established by the EMPLOYER. The EMPLYEE has the right to refuse the illegal order or coercion of dangerous operation from the EMPLOYER’S management personnel. 6.3 雇工应遵守雇主的所有安全操作条款,雇工有权拒绝雇主管理人员非法提出的危险操作的命令和强迫。 CLAUSE 7. OBSERVATION OF THE RULES AND REGULATIONS 条款7. 规章 制度 关于办公室下班关闭电源制度矿山事故隐患举报和奖励制度制度下载人事管理制度doc盘点制度下载 的遵守 7.1 During the entire period of the agreement the EMPLOYEE should have the obligation and responsibility to understand and observe the laws and regulations of the host country and also all the rules and regulations prescribed by the EMPLOYER. The EMPLOYEE should abide by the rules of occupational safety and health as well as, the labor disciplines, professional ethics, and instruction from the EMPLOYER in the execution of the works. 7.1 合同的全过程中,雇工有权利和义务理解和遵守所在国家的法律法规和雇主的相关规章制度。雇工必须遵守职业健康与安全守则,遵守劳动纪律和职业道德,同时接受雇主的教导完成工作。 7.2 During execution of this contract of employment, in the event that the EMPLOYEE violates labor discipline or regulations, the EMPLOYER could impose corresponding punishment or penalty on the EMPLOYEE according to regulations. 7.2 在执行这份雇佣合同时,如果雇工违反劳工纪律或者规章,雇主可以根据规章施加相应的惩罚或罚款。 7.3 If the EMPLOYEE violates the company’s rules and regulations resulting in economic losses, the EMPLOYEE should make economic compensation to the EMPOYER, and even bear related legal liability as for heavy losses. 7.3 如果雇工因违反公司的规章制度造成经济损失,雇工将对雇主进行经济补偿,并且对严重的损失承担法律责任。 CLAUSE 8. MEDICAL BENEFITS, INSURANCE AND COMPENSATION 条款8 医疗福利,保险和赔偿 8.1. The EMPLOYER should provide free Medical Treatment to the EMPLOYEE for the injury caused during work, and also provide emergency medical treatment whenever necessary. 8.1 雇主须为雇工的工伤提供免费医疗,在需要时提供急救。 8.2. During the period of employment, the EMPLOYER should pay Society Insurance Premium on monthly basis as per regulations of Algeria. The EMPLOYER should pay to the EMPLOYEE the amount of claim from the specific insurance company for the Death or Permanent Disablement of EMPLOYEE according to Algeria labor law. At the same time, the EMPLOYER should pay a Commercial Insurance to each EMPLOYEE in Vietnam to ensure the compensation of each EMPLOYEE for the Death or Permanent Disablement of the EMPLOYEE caused during work in Algeria. The settlement of insurance claim above will be dealt by the Vinaconex mec entrusted by the EMPLOYEE and the EMPLOYER will only assist in that process and accept no responsibility for any extra expenses. 8.2 在雇佣期间,雇主须依照阿尔及利亚规程每月支付社会保险费。雇主根据阿尔及利亚劳动法规定的特定保险公司赔偿额来赔偿雇工的死亡和永久残疾。同时雇主在越南为雇工购买一份商业保险以确保雇工在阿尔及利亚工作时出现死亡或永久残疾补偿,以上保险理赔工作由雇工委托的代理处理,雇主只提供相应协助。不再承担其它任何费用。 8.3 The families of the EMPLOYEE working in Algeria should not ask the EMPLOYER to provide any formalities for visiting Algeria for any reason in any case. 8.3.在阿尔及利亚工作的雇工家属在任何情况下不得以任何理由要求雇主提供办理到阿尔及利亚探访 8.4. The EMPLOYER will cover the life accident insurance for the EMPLOYEE for the period from leaving Vietnam till his return to Vietnam. The EMPLOYER should bear the insurance premium。 8.4 从雇工离开越南到他回到越南和在阿尔及利亚工作的这段时间,雇主为所有的雇工承担个人意外伤害保险费。 CLAUSE 9. TERMINATION OF CONTRACT 条款9 合同终止 9.1 If the production and operation condition of the EMPLOER has changed, which makes this contract unable to fulfill, this contract may be modified through mutual consent of both parties. 9.1 如因雇主生产运营条件改变,使其合同无法完成,合同将由双方同意并修改。 9.2 The EMPLOYEE should be responsible for various certificates required by the EMPLOYER for recruitment purpose. If untrue certificate or forged resume is provided, the EMPLOYER is entitled to terminate this Employment Contract. 9.2 雇工有责任提供雇主招聘目的要求的各种证书。如果提供假证或假简历,雇主有权解除雇佣合同。 9.3 The EMPLOYEE also agrees to indemnify the EMPLOYER for any losses caused by his fault in the performance/execution of his work or even termination of this Employment Contract, including but not limited to, the direct economic losses to business and work. 9.3 雇工也同意赔偿雇主因其在工作上的表现/行为失误带来的任何损失,甚至终止这份雇佣合同,包括但不限于商业和工作的直接损失。 9.4 The EMPLOYER should provide the EMPLOYEE with return economy class air ticket upon successful completion of this Employment Contract. However, the EMPLOYEE should pay all expenses, airfare etc. incurred for repatriation if he resigns from employment and this Employment Contract is terminated automatically before expiry. 9.4 雇主将在雇佣合同结束后提供返回经济舱机票。然而,如果雇工辞职,他将自行承担所有费用,机票价等,并且雇佣合同在结束前自动终止。 9.5 The EMPLOYER can terminate the employment and repatriate the EMPLOYEE for any of the following grounds/causes. The EMPLOYEE will be subjected to bear all cost/expenses for repatriation and will not be entitled to any benefits whatsoever. 9.5 雇主可以因以下原因终止或遣返雇工。雇工将承担遣返的所有费用并且不会授予任何报酬。 a) Violation of the laws and regulations of the host country/Algeria.违反主国家的法律法规/阿尔及利亚。 Involvement in violence, theft, destruction or sabotage, arson to EMPLOYER’s properties (Equipments, Machinery, Accommodation, etc.)参与对雇主的财产(设备,机械,住所等)进行暴力,偷窃,毁坏或破坏,纵火。 b) Gambling or idleness during working hours.在工作时间赌博怠工的。 c) Drinking, under the influence of alcohol during working hours.在工作时间喝酒并影响工作。 d) Use of any restricted contraband, any sort of illicit during any time for the entire period of this contract.在整个合同期内的任何时候使用任何限制违禁品,任何种类的毒品。 e) 4days absences from work without reason.无理由缺勤4天 f) Legal punishment to be guilty of crime.犯罪受法律惩罚。 g) For not complying with the EMPLOYER’s instructions on all safety rules and regulations of the working-site and living quarter (accommodation).在居住区(宿舍)和工作场所不听从雇主的安全法律法规的指令。 h) For failure to obey the rules and regulations as imposed and instructed from time to time by the EMPLOYER and its representative without reasonable grounds.没有遵守雇主多次实施指示的规章制度,并且其行为没有合理理由。 i) For engaging in political, union, antisocial activities, agitation and participating in strikes.参与政治,协会,扰乱社会的行为,煽动参与罢工。 j) For neglecting the instructions on equipment control and maintenance.无视机械设备的控制和保养指令。 k) For hindering obstructing or distributing the performance or execution of work.妨碍分配绩效或施工。 l) For working at another company without the consent of the EMPLOYER.没有雇主同意下为其他公司工作。 m) For carrying of contagious sickness/ and all sexually transmitted diseases which requires deportation by the local government authorities of the host country.携带东道国政府机关需要驱逐出境的传染性疾病/和所有的性传播疾病。 n) For any other causes which are analogous to the foregoing.其他与上述类似的条款。 9.6 For involving in any activities or accidents irrelevant of work causing or sustaining any damages, injuries to himself or third party, the EMPLOYEE should be fully responsible for facing all consequences and bearing all costs that may arise from his action(s). The EMPLOYEE shall not be entitled to or make any or whatsoever claims towards the EMPLOYER and Client.参与任何与工作不相关的活动或事故造成或导致自己或第三方破坏,受伤,雇工将对所有的后果负责并承担可能由其行为引起的所有的损失。雇工无权向雇主和委托人提出任何索赔。 CLAUSE 10. Miscellaneous 条款10 其他 10.1. The EMPLOYER should provide basic food and accommodation facilities free of charge, create a clean and good working & living condition under appropriate circumstance. It will be the responsibilities of the EMPLOYEE to keep all such facilities clean and in proper condition. Only three meals (foods) a day will be provided and no form of cash will be substituted. 10.1 雇主免费提供基本的食物和住宿,在适当环境下创作干净的好的工作生活环境。雇工有义务保持所有场所干净,正常状态。一天只提供三餐,任何形式的现金不可代替。 10.2. The EMPLOYEE should abide by all rules and regulations set forth by the EMPLOYER while residing in the accommodation provided by the EMPLOYER. If the EMPLOYEE violates any of the rules and regulations such as staying out all night without authorization, disciplinary action and penalty will be taken against the EMPLOYEE. 10.2 在入住雇主提供的住所时,雇工将遵守雇主预先规定的规章制度。如果雇工违反任何规章制度,例如私自整夜不归,雇工将受到纪律处分或处罚金。 10.3. Transportation for working from accommodation to working-site will be provided by the EMPLOYER. But the EMPLOYER will not provide nor will the EMPLOYEE use the Company vehicles for any personal/private use without the consent and approval of the EMPLOYER. 10.3 为了工作而从住处到现场的往来交通工具由雇主提供,但雇主不必提供,在没有雇主的同意和批准下雇工也不能使用公司交通工具为了私人/个人使用。 10.4. In the event of accident or emergency, the EMPLOYER must notify the local authorities and shall be authorized without further consent of the EMPLOYEE or liability being incurred thereby, to do the following. 10.4 在事故或紧急情况下,雇主必须通知地方当局,无需雇工的同意,如发生责任,做以下处理: a) In the event of the EMPLOYEE’s death during the performance period of the contract in Algeria, the EMPLOYER will be responsible for sending the remaining belongings of the EMPLOYEE back to Vietnam at the EMPLOYER’s own cost.在阿尔及利亚的合同执行期间, 发生雇工死亡,雇主有责任将雇工遗留的财产送回越南。 b) The EMPLOYEE agrees that in the event of his complete mental or physical incapacity, the said EMPLOYER, after consulting with the local authorities concerned may authorize appropriate medical treatment as may be recommended by the qualified medical authorities.雇工认为在事故中其完全身心障碍,上述雇主,在咨询有关地方当局后,可授予权威医学机构推荐的适当的药物治疗。 c) The following person is the EMPLOYEE’s next of kin and should be notified in the event of an emergency. 紧急情况下应通知雇工的亲人。 10.5 All taxes and duties which are official and work related will be borne by the EMPLOYER, but all taxes and duties in Vietnam should be borne by the EMPLOYEE accordingly. 10.5 所有官方的或与工作相关的税收和税金将由雇主承担,但是所有在越南的所有税收和关税由雇工承担。 10.6 The EMPLOYEE should keep strict confidential of the EMPLOYER’s secrets, technical and commercial information grasped during his working period with the EMPLOYER. The EMPLOYEE should indemnify the EMPLOYER for any loss caused by his disclosure of commercial information, which includes direct losses and other expenses incurred by the EMPLOYER for protecting its interests or for avoiding greater losses. 10.6 雇工应为雇主保密,在为雇主工作是得到的技术和商业信息。雇工要承担泄露商业信息带来的所有损失,包括直接损失和其他雇主为了保密或避免更大损失而产生的费用。 10.7 The EMPLOYER and the EMPLOYEE hereby certify that they have read the foregoing agreement, and fully understand its terms and conditions consisting of the entire agreement without ambiguity. 10.7 雇主和雇工在此确定他们已经阅读以上条款,充分理解合同包含的条款条件没有含糊。 CLAUSE 11. CONFLICTION AND LABOUR DISPUTE SETTLEMENT 条款11 冲突和劳动争端解决 11.1 Due to different languages used in both sides and Algeria, ENGLISH should be the only formal version with legal effect. This contact of employment is made in triplicate, each of which should have the same legal effect after being signed by both parties. The EMPLOYER, the EMPLOYEE and Vinaconexmec each should hold one copy. 11.1 因为在双方和阿尔及利亚使用不同的语言,英语为唯一有法律效益的正式版本。此合同一式三份,双方签订后具有同等的法律效力,雇主,雇工和越南劳务公司各持一份。 11.2 Any disputes arising from execution of this contract should be settled between both parties through amicable negotiations, failing which, the laws and regulations of Algeria shall prevail. 11.2 合同执行中的所有争论将双方通过友好谈判解决,如果没有,阿尔及利亚法律法规占优先地位。 11.3 Anything unmentioned herein shall be negotiated between both parties.
