Certain Provisions of the Supreme People's Court on Restricting Extravagant Spending of Enforcees 最高人民法院关于限制被执行人高消费的若干规定 Promulgating Institution: Supreme People's Court Document Number: Fa Shi [2010] No. 8 Promulgating Date: 07/01/2010 Effective Date: 10/01/2010 Validity Status: Valid 颁布机关: 最高人民法院 文 号: 法释[2010]8号 颁布时间: 07/01/2010 实施时间: 10/01/2010 效力状态: 有效 Text 正文 (Adopted at the 1487th Session of the Judicial Committee of the Supreme People's Court on May 17, 2010) （2010年5月17日最高人民法院审判委员会第1487次会议通过） These Provisions are formulated in accordance with the Civil Procedure Law of the People's Republic of China and by combining the practice experience of people's courts in enforcement, for the purposes of strengthening the enforcement, promoting the building of social credit mechanism, and protecting the legitimate rights and interests of the enforcement applicants and the parties subject to enforcement. 为进一步加大执行力度，推动社会信用机制建设，最大限度保护申请执行人和被执行人的合法权益，根据《中华人民共和国民事诉讼法》的有关规定，结合人民法院民事执行工作的实践经验，制定本规定。 Article 1 If an enforcee fails to fulfill the payment obligations determined in the effective legal documents within the term prescribed in the enforcement notice, the people's court may restrict its extravagant spending. 第一条 被执行人未按执行 通知 关于发布提成方案的通知关于xx通知关于成立公司筹建组的通知关于红头文件的使用公开通知关于计发全勤奖的通知 书 关于书的成语关于读书的排比句社区图书漂流公约怎么写关于读书的小报汉书pdf 指定的期间履行生效法律文书确定的给付义务的,人民法院可以限制其高消费。 Article 2 Where a people's court decides to adopt measures restricting luxury consumption, it shall take into account factors such as whether the enforcee has been passive in performing the obligations or has evaded or rejected the enforcement, and its performance ability. 第二条 人民法院决定采取限制高消费措施时,应当考虑被执行人是否有消极履行、规避执行或者抗拒执行的行为以及被执行人的履行能力等因素。 Article 3 If the enforcee is a natural person, after he is restricted from extravagant spending, he shall not use his property to pay for the following expenses: (1) Choosing to fly via plane, a soft sleeper in a train, or second-class on a ship, for travelling; (2) Spending in multi-star-rated hotels, restaurants, night clubs, golf courses, etc.; (3) Purchasing real property, or newly-constructing or expanding houses, or decorating houses in a luxurious manner; (4) Renting high-class office buildings, hotels apartments, or other office premises; (5) Purchasing cars that are not necessary for business; (6) Going on tours or vacation; (7) Sending children to private schools with expensive tuition; (8) Spending a large sum in purchasing insurance wealth management products; and (9) Other luxury consumption acts that are not necessary in either his daily life or work. If the enforcee is an organization, after it is restricted from extravagant spending, the party and its legal representative, and the directly responsible persons who may affect the performance of the debts shall be prohibited from using the property of the organization to commit the acts prescribed in Paragraph 1 of this article. 第三条 被执行人为自然人的,被限制高消费后,不得有以下以其财产支付费用的行为: (一)乘坐交通工具时,选择飞机、列车软卧、轮船二等以上舱位; (二)在星级以上宾馆、酒店、夜总会、高尔夫球场等场所进行高消费; (三)购买不动产或者新建、扩建、高档装修房屋; (四)租赁高档写字楼、宾馆、公寓等场所办公; (五)购买非经营必需车辆; (六)旅游、度假; (七)子女就读高收费私立学校; (八)支付高额保费购买保险理财产品; (九)其他非生活和工作必需的高消费行为。 被执行人为单位的,被限制高消费后,禁止被执行人及其法定代表人、主要负责人、影响债务履行的直接责任人员以单位财产实施本条第一款规定的行为。 Article 4 Restriction on extravagant spending shall generally be applied for by the enforcement applicant, and shall be decided by the people's court through examination. When necessary, the people's court may decide on it according to its duties and powers. 第四条 限制高消费一般由申请执行人提出书面申请,经人民法院审查决定;必要时人民法院可以依职权决定。 Article 5 Where a people's court decides to restrict extravagant spending, it shall issue an extravagant spending restriction order to the enforcee. The luxury extravagant spending order shall be issued by the president of the people's court. The order shall specify the term of the restriction, the items restricted, and the legal consequences, etc. 第五条 人民法院决定限制高消费的,应当向被执行人发出限制高消费令。限制高消费令由人民法院院长签发。限制高消费令应当载明限制高消费的期间、项目、法律后果等内容。 Article 6 A people's court shall, according to the needs of the case and the status of the enforcee, serve the enforcement assistance notices on the entities under the obligation to assist with the investigation and enforcement, and may also make a public announcement on relevant media. 第六条 人民法院根据案件需要和被执行人的情况可以向有义务协助调查、执行的单位送达协助执行通知书,也可以在相关媒体上进行公告。 Article 7 The expenses for making a public announcement on the extravagant spending restriction order shall be borne by the enforcee. If the enforcement applicant applies for making an announcement on the media, the applicant shall advance the payment for the expenses of the announcement. 第七条 限制高消费令的公告费用由被执行人负担;申请执行人申请在媒体公告的,应当垫付公告费用。 Article 8 If the enforcee restricted from extravagant spending has to have the consumption activities prohibited herein due to its/his daily lives or business operation, it/he shall file an application with the people's court and may do so upon approval. 第八条 被限制高消费的被执行人因生活或者经营必需而进行本规定禁止的消费活动的,应当向人民法院提出申请,获批准后方可进行。 Article 9 During the period of extravagant spending restriction period, if the enforcee provides an effective guarantee or is subject to the consent of the enforcement applicant, the people's court may lift the extravagant spending restriction order. After the enforcee has fulfilled the obligations determined in the effective legal documents, the people's court shall, within the scope of notice or announcement prescribed in Article 6 of these Provisions, lift the extravagant spending restriction order with a notice or public announcement. 第九条 在限制高消费期间,被执行人提供确实有效的担保或者经申请执行人同意的,人民法院可以解除限制高消费令;被执行人履行完毕生效法律文书确定的义务的,人民法院应当在本规定第六条通知或者公告的范围内及时以通知或者公告解除限制高消费令。 Article 10 A people's court shall set a reporting line or mail box to accept the reports of the enforcement applicant or the public regarding the violation of Article 3 of these Provisions by enforcees restricted from extravagant spending, and shall examine and identify those reports. 第十条 人民法院应当设置举报电话或者邮箱,接受申请执行人和社会公众对被限制高消费的被执行人违反本规定第三条的举报,并进行审查认定。 Article 11 If the enforcee has any spending in violation of the extravagant spending restriction order, which can be deemed as a failure to fulfill the effective judgment or ruling made by a people's court, after the case is affirmed, detainment or fines shall be imposed in accordance with Article 102 of the Civil Procedure Law. If the case is of a grave nature and constitutes a crime, criminal liabilities shall be pursued. After receipt of the enforcement assistance notice issued by the people's court, if any relevant organization permits the extravagant spending activities by the enforcee, the people's court shall pursue its legal liabilities in accordance with the provisions of Article 103 of the Civil Procedure Law of the People's Republic of China. 第十一条 被执行人违反限制高消费令进行消费的行为属于拒不履行人民法院已经发生法律效力的判决、裁定的行为,经查证属实的,依照《中华人民共和国民事诉讼法》第一百零二条的规定,予以拘留、罚款;情节严重,构成犯罪的,追究其刑事责任。 有关单位在收到人民法院协助执行通知书后,仍允许被执行人高消费的,人民法院可以依照《中华人民共和国民事诉讼法》第一百零三条的规定,追究其法律责任。 Article 12 These Provisions shall become effective on October 1, 2010. 第十二条 本规定自2010年10月1日起施行。 TOP © 2007 – 2011 Thomson Reuters, all rights reserved
