《职工带薪年休假条例》(英文版)AnnouncementoftheStateCouncilontheRegulationsofPaidAnnualLeaveofEmployees发文日期12-14-2007内容分类Employment&LaborLaw发文机关theStateCouncil文号OrderoftheStateCouncil[2007]No.514时效性Effective生效日期2008-01-01有效范围NationalAnnouncementoftheStateCouncilontheRegulationsofPaidAnnualLeaveofEmployeesOrderoftheStateCouncil[2007]No.514December14,2007TheRegulationsofPaidAnnualLeaveofEmployeesadoptedatthe198thGeneralMeetingoftheStateCouncilonDecember7,2007areherebypromulgatedandshallbeeffectiveasofJanuary1,2008.Primer:WenJiabao,Appendix:RegulationsofPaidAnnualLeaveofEmployeesArticle1TheseRegulationsareformulatedinaccordaneewiththeLaborLawandthePublicServantsLawinordertoprotecttherightstorestdaysandannualleaveofemployeesanddeployemployeestoactivelydischargetheirduties.Article2Theemployeesofunitssuchasauthorities,organizations,enterprises,institutions,privatenon-enterpriseunitsandindividually-ownedcommercialandindustrialbusinesseswithemployeesthathavebeenworkedcontinuouslyformorethanoneyearareentitledtopaidannualleave(hereinafterreferredtoas"annualleave").Unitsshallguaranteethatemployeesareentitledtoannualleave.Employeestakingannualleaveareentitledtothewagesofanormalworkingday.Article3Whereanemployeehasservedonefullyearbutlessthan10yearsaccumulatively,heisentitledtofivedaysofannualleave.Ifhehasserved10fullyearsbutlessthan20years,annualleaveis10days.Ifhehasservedfor20fullyears,annualleaveis20days.Article4Anemployeeisnotentitledtoannualleaveforthecurrentyearifheisunderanyofthefollowingcircumstances:Theemployeeisentitledtosummerandwintervacationsinaccordancewiththelawandthenumberofdaysofsuchvacationsismorethanthatofhisannualleave;Theemployeehastakenmorethan20daysofcasualleaveaccumulativelyandhisunitdoesnotdeductwagesinaccordaneewithprovisions;Theemployeehasservedonefullyearaccumulativelybutlessthan10yearsandhastakenmorethantwomonthsofsickleaveaccumulatively;Theemployeehasserved10fullyearsaccumulativelybutlessthan20yearsandhastakenmorethanthreemonthsofsickleaveaccumulatively;Theemployeehasservedmorethan20fullyearsandhastakenmorethanfourmonthsofsickleaveaccumulatively.Article5Unitsshallcoordinateandarrangefortheannualleaveofemployeesonthebasisofthespecificconditionsofproductionandworkandtheindividualpreferenceofemployees.Annualleavemaybecentrallyarrangedwithinoneyearorinseveralperiodsanddoesnotspanmorethanoneyearingeneral.Unitsmaymakesucharrangementthatspansmorethanoneyeariftheyhaveagenuineneedforsucharrangementduetoproductionandjobspecialties.Unitsthatcannotarrangeforannualleaveforemployeesduetojobrequirements,theymaynotarrangeforannualleavewiththeconsentofsuchemployees.Inrespectoftheannualleavethatshouldhavebeentakenbutotherwise,unitsshallpaywageremunerationtosuchemployeesattherateof300%ofthedailywageincomeofsuchemployees.Article6Thepersonneldepartmentandthelaborsecuritydepartmentofpeople'sgovernmentsatthecountyleveloraboveshallactivelyconductsupervisionandexaminationontheimplementationoftheseRegulationsbyunitsinaccordancewiththeirauthority.Labororganizationsshallprotecttherightstoannualleaveofemployeesinaccordancewiththelaw.Article7WhereaunitfailstoarrangeforannualleaveforemployeesandpaywageremunerationonannualleaveinaccordancewiththeRegulations,thepersonneldepartmentorthelaborsecuritydepartmentofpeople'sgovernmentsatthecountyleveloraboveshallorderrectificationwithinatimelimit.Ifnorectificationismadewithinthetimelimit,suchunitshallbeorderedpaymentofwageremunerationonannualleaveandalsomakeadditionalcompensationtoemployeesonthebasisoftheamountofthewageremunerationofannualleave.Wherenowageremunerationonannualleaveorcompensationismade,andthepersonnelofsuchunitsarepublicservantsoradministeredwithreferencetothePublicServantsLaw,theperson-in-chargethatisdirectlyresponsibleandotherdirectlyresponsiblepersonnelshallbepunishedinaccordancewiththelaw,ifsuchunitbelongstoothercategories,thelaborsecuritydepartment,thepersonneldepartmentortheemployeeshallapplyforcompulsoryimplementationbyapeople'scourt.Article8Whereemployeesandunitshavedisputeoverannualleave,itshallbedealtwithinaccordaneewiththerelevantlawsandadministrativeregulationsofthestate.Article9ThepersonneldepartmentoftheStateCouncilandthelaborsecuritydepartmentoftheStateCouncilshallformulateimplementingproceduresoftheRegulationsrespectivelyinaccordaneewiththeirrespectiveauthority.Article10TheRegulationsshallbeeffectiveasofJanuary1,2008.
