4. The full base Rent shall be payable on the first day of each month. The
first month’s rent shall be payable on ___/___/___. Deposit arrangements
are as follows:

5. The Deposit is acknowledged by the Landlord as received from the
Tenants in the sum of $C______________ as a security deposit to secure the
tenants performance of the obligations established under this Lease
Agreement. The following shall apply to the deposit:

6. The Tenant’s Joint and Severally Responsibility: There are ___ persons listed
above as the Tenants co-occupying the Premises, who all accept joint
and severally responsibility for the full obligation for the full Term of this
Lease Agreement. Should an individual tenant vacate the Premises
before the end of the Term, his/her obligations remain and defer to all of
the remaining Tenants. A new tenant maybe substituted for by the
remaining Tenants, if a new tenant that is acceptable to the Landlord
executes the Lease. The tenant is required to give 60 days written notice
to end lease agreement with the landlord. During this time the Landlord
has permission to show the property to prospective tenants. The Landlord
shall give the tenant 24 hours notice before entering the premises for
showings.
7. The Guarantors: Each Tenant shall have a Guarantor whose names are
respectively listed below corresponding to the Tenant’s number above
and whose signatures follow at the end of the Lease document if required.

8. No other Occupants: Except for casual guests, no persons other than the

10. Maintenance of Premises:

a) Appliances: The Landlord shall provide for building integrity and
appliances operability in the condition that complies with the Landlord and
Tenant Board.
b) The Tenants shall maintain the Premises, appliances and equipment in the
condition received.
c) Outdoor Maintenance: The Tenants agree to mow and water the lawn and to keep the lawn, flowerbeds and shrubbery in good order and
condition. Tenants are required to rake leaves and remove at their expense
should this service not be provided by the Landlord. (Yes)

d) Snow Removal: Tenants shall be responsible to keep the sidewalk surrounding the premises free and clear of all ice and snow. (Yes)

e) Garbage Removal: It is the responsibility of the Tenants to ensure that all garbage and recycling is being brought to the curb on a weekly basis.
Surplus bags are to be tagged as per the City bylaw. Please ensure that you
familiarize yourselves with the garbage day and bag tagging requirements.
In the event that Tenants are neglecting removal of personal waste from the
outside of the building they shall be notified in advance by the Property
Manager who shall use his/her own discretion to order a crew to look after
the maintenance of the property. The Tenants shall be charged $35.00 per
visit plus dumping fees made by the Outdoor Maintenance Crew that shall
be due promptly within 10 days of receipt of invoice.
f) Plumbing: In case water or waste pipes become clogged by reason of the
Tenant’s neglect, recklessness or own doing, the Tenant shall repair at his/her
own expense (i.e. Toilet or Sink) as well as pay for all damage caused. The
Tenants shall take due precautions against freezing of water or waste pipes
and stoppage of the same in and about the Premises.
g) Smoking: shall not be permitted in the rental unit at any time.
h) Cleanliness: Tenants shall ensure that the rental unit is kept clean and
orderly at all times. This includes regular vacuuming, washing dishes, cleaning
the washrooms and common areas. The Tenants shall ensure that the
premises is left clean and all garbage is removed from the property upon
vacating the premises at the end of their Lease Term, otherwise the Tenants
shall be billed for all costs incurred for Cleaning Services and Garbage
Removal Services including labour and dumping fees. All common areas are

to be kept free and clear of Tenants possessions excluding furnishings or items
of use by all Tenants co-occupying the premises.

11. Right of Re-entry/Inspections: The Landlord shall give one day’s Notice of
his/her intent to enter the Tenant’s Premises during reasonable hours but
such Notice need not be given in the event of an emergency or if the
Tenant consents to the Landlord’s entry without such Notice being given.
The landlord reserves the right to inspect the premises once a month for a
health, safety, cleanliness and maintenance inspection.
12. Overholding: If the Tenant remains in possession after a lawful expiry
termination without the Landlord’s consent the Landlord may apply to the
Ontario Court (General Division) for an Order of Possession. The Landlord
may also recover damages from an overholding Tenant which exceeds
the amount of any retained security deposit.
13. Pre-inspection: The Tenants, each and all acknowledge having inspected
the Premises prior to taking possession and found the Premises to be in
good and clean condition and that all appliances and equipment and
services listed herein are present and in good working order. Any
deficiencies in this regard are hereby listed on the attached Appendix A:
Schedule of assumed damages, otherwise, unless duly noted on the
Appendix A, the Tenants accept possession as acknowledged hereby.
14. OTHER CONDITIONS OR PROVISIONS:

a) Access: The Tenants permit the Landlord to enter the Premises during their
absence, should they not be able to reach the Tenants directly.
b) Subletting: The Tenant agrees not to assign or sublet the Premises without
the Landlord’s written permission and consent. The Landlord shall not
unreasonably withhold consent.
c) Increase in Rent: The Landlord agrees not to raise the rent for the next 12
months and any increase given shall be in accordance with the
applicable provincial Landlord/Tenant Act.
d) Partying: The Tenant is not to have any excessive parties that cause
disruption to the other tenants. The Landlord reserves the right to have any
and all guests removed from the Premises at any time if called. At this time
appropriate police agencies will be advised. Action may be initiated that
may include but not limited to the termination of this lease agreement.
e) Illegal Activity: The tenant shall never engage in any illegal activities in or
on the premises (including but not limited to operating a business,
gambling establishment selling of illegal drugs, Etc,)
f) Vandalism and Disturbances: Any and all complaints from the neighbours
regarding a tenant’s poor behavior, loudness destruction of property,
vandalism or otherwise shall not be tolerated by the Landlord in any way.
Any and all complaints from the neighbors shall be reviewed as
appropriate and communicated in writing and forwarded to the Tenants
and may serve as a basis for Termination of the said Lease Agreement.
g) Fire Safety: The Tenant is not to have within the bedrooms any appliances
including but not limiting, space heaters, fridges, freezers, microwaves or
cooking equipment of any type. The Tenants shall sign a waiver upon
taking possession of the property that warrants that the house includes
working smoke detectors and fire extinguishers. Upon signing the Waiver it
shall be the Tenants responsibility to ensure that the smoke detectors and
fire extinguishers are in working order at all times. The Landlord will also
inspect these items on a semi-annual basis.
h) Keys: The Tenant shall be issued a copy of the Key to the Property upon
taking possession. It shall be the Tenants responsibility to ensure that all
keys are returned at the end of the Lease Term. Replacement keys shall
be issued at a rate of $10.00/key.

15. Insurance: The Landlord will insure the Premises for standard coverage.
The Tenants shall provide their own Tenant’s Insurance coverage for their
contents and their personal liability; such coverage may be made by an
extension from a Guarantors home owner’s policy. A Certificate of
insurance shall be forwarded to the Landlord as proof of such insurance.
16. Entire Agreement: This document is agreed to be a complete record of the residential Tenancy Lease Agreement. Both and all Parties signature
hereto are to have a complete copy of this Agreement. All
representations, commitments and agreements must be included herein
in writing and agreed to by all Parties or they are not enforceable.
