1.WARRANTY-VOYAGE-CARGO.Thevessel,classedasspcifiedinPartⅠhereof,andtobesomaintainedduringthecurrencyofthisCharter,shall,withallconveientdispatchproceedasorderedtoLoadingPort(s)namedinaccordingwithClause4hereof,orsonearthereuntoasshemaysafelyget(alwaysafloat),andbeingseaworthy,andhavingallpipes,pumpsandheatercoilsingoodworkingorder,andbeingineveryrespectfittedforthevoyage,sofarastheforegoingconditioncanbeattainedbytheexerciseofduediligence,perilsoftheseaandanyothercauseofwhatsoeverkindbeyondtheOwner'sand/orMaster'scontrolexcepted,shallload(alwaysafloat)fromthefactorsoftheChartererfullandcompletecargoofpetroleumand/oritsproductsinbulk,notexceedingwhatshecanreasonablystowandcarryoverandaboveherbunkerfuel,consumablestores,boilerfeed,culinaryanddrinkingwater,andcomplementandtheireffects(sufficientspacetobeleftinthetankstoprovidefortheexpansionofthecargo),andbeingsoloadedshallforthwithproceed,asorderedonsigningBillsofLading,directtotheDischargingPort(s),orsonearthereuntoasshemaysafelyget(alwaysafloat),anddeliversaidcargo.IfheatingofthecargoisrequestedbytheCharterer,theOwnershallexerciseduediligencetomaintainthetemperaturesrequested.保证--航次--货物本船具有第一部分所述船级,并应在本租船 船长所指定的卸货港:地点在前往位于下列区域的港口的航次中地角英国/大陆(波尔多/汉堡区域)或斯堪的那维亚(包括丹麦)苏伊士地中海(自波斯湾)直布罗陀地中海(自西半球)3)任何与变更(已指定的)装货港或卸货港有关的额外费用,应由承租人支付,本船因此损失的时间应计为实用装卸时间。25.LAYDAYS.LaytimeshallnotcommencebeforethedatestipulatedinPart,expectwiththeCharterer'ssanction.ShouldtheVesselnotbereadytoloadby4:00o'clockP.M.(localtime)onthecancellingdatestipulatedinPart,theCharterershallhavetheoptionofcancellingthisCharterbygivingOwnernoticeofsuchcancellationwithintwenty-four(24)hoursaftersuchcancellationdate:otherwisethisChartertoremaininfullforceandeffect.受载期除非承租人同意,在第一部分规定的日期之前不起算装卸时间。如本船在第一部分规定的解约日下午4时(地方时)之前尚未作好装货准备,则承租人可选择在解约日之后24小时之内通知船东解除本租船合同。否则,本租船合同仍具有完全效力。6.NOTICEOFREADINESSUponarrivalatcustomaryanchorageateachportofloadingofdischarge,theMasterorhisagentshallgivetheChartererorhisagentnoticebyletter,telegraph,wireleortelephonethattheVesselisreadytoloadordischargecargo,berthornoberth,andlaytime,ashereinafterprovided,shallcommenceupontheexpirationofsix(6)hoursafterreceiptofsuchnotice,orupontheVessel'sarrivalinberth(i.e.,finishedmooringwhenatasealoadingordischargingterminalandallfastwhenloadingordischargingalongsideawharf),whicheverfirstoccurs.However,wheredelayiscausedtoVesselgettingintoberthaftergivingnoticeofreadinessforanyreasonoverwhichChartererhasnocontrol,suchdelayshallnotcountasusedlaytime.准备就绪通知书本船到达每一装货港或卸货港习惯锚泊地点,船长或其代理人应用信件、电报、无线电或电话通知承租人或其代理人本船已作好装货或卸货准备,而不论本船靠泊与否。装卸时间(见后规定)从收到通知书6小时后或者本船到达泊位(即在海上装货或卸货泊位靠完泊或在码头边装货或卸货时,系妥缆绳)之时起算,以较早者为准。如本船递交装卸准备就绪通知书后因承租人不能控制的原因延误本船进入泊位,此种延误不应计为实用装卸时间。7.HOURSFORLOADINGANDDISCHARGING.ThenumberofrunninghoursspecifiedaslaytimeinPartⅠshallbepermittedtheChartereraslaytimeforloadinganddischargingcargo;butanydelayduetotheVessel'sconditionorbreakdownorinabilityoftheVessel'sfacilitiestoloadordischargecargowithinthetimeallowedshallnotcountasusedlaytime.IfregulationsoftheOwnerorportauthoritiesprohibitloadingordischargingofthecargoatnight,timesolostshallnotcountasusedlaytime;iftheCharterer,shipperofconsigneeprobibitsloadingordischargingatnight,timesolostshallcountasusedlaytime.Timeconsumedbythevesselinmovingfromloadingordischargeportanchoragetoherloadingordischargeberth,dischargingballastwaterorslops,willnotcountasusedlaytime.7.装货和卸货时数第一部分规定的连续小时数应是允许承租人使用的装货和卸货时间,但因本船的条件或本船设备损坏而不能在规定时间内完成装货或卸货而造成的任何延误不应计为实用装卸时间。如船东或港口当局的规则禁止夜间装货或卸货,因而损失的时间不应计为实用装卸时间。如承租人、托运人或收货人禁止夜间装货或卸货,因而损失的时间应计为实用装卸时间。本船从装货港或卸货港锚地移至装货或卸货泊位所用的时间和排除压载水及污水所用的时间,不应计为实用装卸时间。38.DEMURRAGE.CharterershallpaydemurrageperrunninghourandprorateforapartthereofattheratespecifiedinPartⅠforalltimethatloadinganddischargingandusedlaytimeaselsewherehereinprovidedexceedstheallowedlaytimeelsewherehereinspecified.If,however,demurrageshallbeincurredatportsofloadingand/ordischargebyreasonoffire,explosion,stormorbyastrike,lockout,stoppageorrestraintoflabororbybreakdownofmachineryorequipmentinorabouttheplantoftheCharterer,supplier,shipperorconsigneeofthecargo,therateofdemurrageshallbereducedone-halfoftheamountstatedinPartⅠperrunninghourorprorateforpartofanhourfordemurragesoincurred.TheCharterershallnotbeliableforanydemurragefordelaycausedbystrike,lockout,stoppageorrestraintoflaborforMaster,officersandcrewoftheVesselortugboatorpilots.滞期费如果装货和卸货所用的时间及本合同规定的其他实用装卸时间超过本合同规定的可用装卸时间,承租人应根据第一部分规定的费率,按每一连续小时(不足一小时按比例计算)支付滞期费。但是,如装货港和/或卸货港出现的滞期系承租人、供货人、货物托运人或收货人工厂内外火灾、爆炸、风暴或由于罢工、关厂、停工或劳动限制或因机器或设备损坏所致,滞期费率应减第一部分规定的每连续小时(不足一小时按比例计算)滞期费的一半。对本船船长、船员或拖轮或引航员的罢工、停业、停工或劳动限制造成的延误,承租人不负责滞期费。9.SAFEBERTHING-SHIFTING.Thevesselshallloadanddischargeatanysafeplaceorwharf,oralongsidevesselsorlightersreachableonherarrival,whichshallbedesignatedandprocuredbytheCharterer,providedtheVesselcanproceedthereto,lieat,anddeparttherefromalwayssafelyafloat,anylighteragebeingattheexpense,riskandperiloftheCharterer.TheCharterershallhavetherightofshiftingtheVesselatportsofloadingand/ordischargefromonesafeberthtoanotheronpaymentofalltowageandpilotageshiftingtonextberth,chargesforrunninglinesonarrivalatandleavingthatberth,additionalagencychargesandexpense,customsovertimeandfees,andanyotherextraportchargesorportexpensesincurredbyreasonofusingmorethanoneberth.TimeconsumedonaccountofshiftingshallcountasusedlaytimeexceptasotherwiseprovidedinClauses15.安全靠泊--移泊本船应在承租人指定并获得的、本船能驶抵、停留和驶离且一经到达即可挂靠的安全地点或码头、或船边或驳船边装货和卸货。货物过驳的任何费用、风险和危险由承租人承担。承租人有权在装货港和/或卸货港将船舶从一个安全泊位移至另一个安全泊位,但须支付移至下一个泊位所需的一切拖带费和引航费,以及抵达和驶离该泊位所需的航路费、额外代理费、加班费和其他费用,以及因使用多泊位而引起的额外港口费用。移泊所用时间应计为实用装卸时间,但第15条另外规定者除外。10.PUMPINGINANDOUT.ThecargoshallbepumpedintotheVesselattheexpense,riskandperiloftheCharterer,andshallbepumpedoutoftheVesselatth4eexpenseoftheVessel,butattheriskandperiloftheVesselonlysofarastheVessel'spermanenthoseconnections,wheredeliveryofthecargoshallbetakenbytheChartereroritsconsignee.IfrequiredbyCharterer,Vesselafterdischargingistoclearpipelinesofcargobypumpingwaterthroughthemandtimeconsumedforthispurposeshallapplyagainstallowedlaytime.TheVesselshallsupplyherpumpsandthenecessarypowerfordischarginginallports,aswellasnecessaryhands.However,shouldtheVesselbepreventedfromsupplyingsuchpowerbyreasonofregulationsprohibitingfiresonboard,theChartererorconsigneeshallsupply,atitsexpense,allpowernecessaryfordischargingaswellasloading,buttheOwnershallpayforpowersuppliedtotheVesselforotherpurposes.Ifcargoisloadedfromlighters,theVesselshallfurnishsteamatCharterer'sexpenseforpumpingcargointotheVessel,ifrequestedbytheCharterer,providingtheVesselhasfacilitiesforgeneratingsteamandispermittedtohavefiresonboard.Allovertimeofofficersandcrewincurredinloadingand/ordischargingshallbeforaccountoftheVessel.10.泵入与泵出货物泵入本船的费用、风险和危险应由承租人承担;货物泵出本船的费用由本船承担,但本船承担风险和危险仅以本船永久性输油管连接处为限,承租人或收货人在该处接取货物。如经承租人要求,本船卸货后应向岸上输油管泵水以清洗输油管,因此所用时间应计为实用装卸时间。本船在各国应提供卸货所用泵和必要的动力及人员。但如有关规则禁止船上明火而使本船无法提供此种动力,则承租人或收货人应提供卸货以及装货所需动力并承担费用,但为其他用途提供给本船的动力的费用,应由船东支付。如货物从驳船上装入本船,经承租人要求,本船应提供将货物泵入本船所需的蒸汽,其费用由承租人承担,但以本船具有产生蒸汽之设备及允许在船上明火为条件。在装货和/或卸货期间船员的加班费由本船承担11.HOSES:MOORINGATSEATERMINALSHosesforloadinganddischargingshallbefurnishedbytheChartererandshallbeconnectedanddisconnectedbytheChartereror,attheoptionoftheOwner,bytheOwnerattheCharterer'sriskandexpense.Laytimeshallcontinueuntilthehoseshavebeendisconnected.WhenVesselloadsordischargesataseaterminal,theVesselshallbeproperlyequippedatOwner'sexpenseforloadingordischargingatsuchplace,includingsuitablegroundtackle,mooringlinesandequipmentforhandlingsubmarinehoses.11.输油管路:系泊于海泊位装货和卸货所需管路应由承租人提供并负责连接和摘除,或者,经船东选择,由船东负责连接和摘除,但风险和费用由承租人承担。装卸时间计算至管路摘除为止。如本船在海上泊位装货或卸货本船应具有在此种地点装货或卸货所需的适当设备,包括适当的锚泊属具、系泊缆绳和水下输油管路操作设备,并由船东承担费用。12.DUES-TAXES-WHARFAGE.TheCharterershallpayalltaxes,duesandotherchargesonthecargo,includingbutnotlimitedtoCustomsovertimeonthecargo,VenezuelanHabilitationTax,C.I.M.TaxesatLeHavreandPortugueseImposto5deComercioMaritime.TheCharterershallalsopayalltaxesonfreightatloadingordischargingportsandanyunusualtaxes,assessmentsandgovernmentalchargeswhicharenotpresentlyineffectbutwhichmaybeimposedinthefutureontheVesselorfreight.TheOwnershallpayallduesandotherchargesontheVessel(whetherornotsuchduesorchargesareassessedonthebasisofquantityofcargo),includingbutnotlimitedtoFrenchdroitsdequaiandspanishderramastaxes.Thevesselshallbefreeofchargesfortheuseofanywharf,dock,placeormooringfacilityarrangedbytheChartererforthepurposeofloadingordischargingcargo;however,theOwnershallberesponsibleforchargesforsuchberthwhenusedsolelyforVessel'spurposes,suchasawaitingOwner'sorders,tankcleaning,repairs,etc.before,duringorafterloadingordischarging.12.捐税--税金--码头费承租人应支付各种货物税款、应付款及其他费用,包括但不限于有关货物的海关加班费、委内瑞拉供给税、勒阿弗尔海上贸易进口税,以及葡萄牙海上贸易进口税。承租人还应支付在装货港或卸货港的各种运费税,以及虽然目前并未征收,但将来可能向本船或运费征收的各种特别税和政府费用。船东应支付向本船征收的各种捐税和其他费用(不论此捐税或费用是否按货物数量计收),包括但不限于法国码头税和西班牙derramas税。本船应免费使用承租人为装货或卸货安排的任何码头、港池、场所或系泊设施,但船东应承担仅为本船目的,如装货或卸货之前、期间或之后等候船东命令、油舱清洗、修理等而使用此种泊位的费用。(a).CARGOESEXCLUDEDVAPORPRESSURE.CargoshallnotbeshippedwhichhasavaporpressureatonehundreddegreesFahrenheit(100℉.)inexcessofthirteenandone-halfpounds(13.5lbs.)asdeterminedbythecurrentA.S.T.M.Method(Reid)D-323.(b).FLASHPOINT.CargohavingaflashpointunderonehundredandfifteendegreesFahrenheit(115.)(closedcup)A.S.T.M.MethodD-56shallnotbeloadedfromlightersbutthisclauseshallnotrestricttheChartererfromloadingortoppingoffCrudeOilfromvesselsorbargesinsideoroutsidethebaratanyportorplacewherebarconditionsexist.13.(1)除外蒸气压力的货物货物如在华氏100度时,按美国材料试验协会现行规程(Reid)D一323测试的蒸气压力超过13.5磅,则不得装船。闪点货物如按美国材料试验协会规程D-56测试的闪点(闭口)低于华氏115度,则不得从驳船上装入本船,但此款规定并不限制承租人在有浅滩的港口或地点,在浅滩以内或以外从其他船舶或驳船将原油装入本船或装满油舱。(a).ICE.Incaseportofloadingordischargeshouldbeinaccessibleowingtoice,thevesselshalldirecthercourseaccordingtoMaster'sjudgment,notifyingbytelegraphorradio,ifavailable,theCharterers,shipperorconsignee,whoisboundtotelegraphorradioordersforanotherport,whichisfreefromiceandwheretherearefacilitiesfortheloadingorreceptionofthecargoinbulk.ThewholeofthetimeoccupiedfromthetimetheVesselisdivertedbyreasonoftheiceuntilherarrivalatanice-freeportofloadingordischarge,asthecasemaybe,shallbepaidforbythe6ChartereratthedemurrageratestipulatedinPartⅠ.(b).IfonaccountoficetheMasterconsidersitdangeroustoenterorremainatanyloadingordischargingplaceforfearoftheVesselbeingfrozeninordamaged,theMastershallcommunicatebytelegraphorradio,ifavailable,withtheCharterer,shipperorconsigneeofthecargo,whoshalltelegraphorradiohiminreply,givingorderstoproceedtoanotherportasperClause14(a)wherethereisnodangeroficeandwheretherearethenecessaryfacilitiesfortheloadingorreceptionofthecargoinbulk,ortoremainattheoriginalportattheirrisk,andineithercaseCharterertopayforthetimethattheVesselmaybedelayed,atthedemurrageratestipulatedinPart.14.(1)冰冻如装货港或卸货港因冰冻本船不能驶入,本船应按船长的判断确定航线,如可行,应用电报或无线电通知承租人、托运人或收货人。承租人、托运人或收货人应用电报或无线电指定另一不冻且有装载或接收散装货油设备的港口。从本船因冰冻原因而开始改向至驶抵不冻的装货港或卸货港(视情况而定)所用时间,应由承租人按第一部分规定的滞期费率支付费用。如因冰冻船长认为驶入或停留在装货港或卸货港有危险,担心本船会受冰封或损坏,如果可行,船长应用电报或无线电与承租人、货物托运人或收货人联系。承租人、货物托运人或收货人应用电报或无线电予以答复,指示本船按第14条(1)的规定驶往另一无冰冻危险,且具有装载或接收散装货油的必要设备的港口,或者,指示本船停留于原定港口而由他们承担风险。无论何种情况,对本船可能延误的时间,承租人均应按第一部分规定的滞期费率支付费用。15.TWOORMOREPORTSCOUNTINGASONE.TotheextentthatthefreightratestandardofreferencespecifiedinPartⅠFhereofprovidesforspecialgroupingsorcombinationsofportsorterminals,anytwoormoreportsorterminalswithineachsuchgroupingorcombinationshallcountasoneportforpurposesofcalculatingfreightanddemurrageonly,subjecttothefollowingconditions:(a)CharterershallpayfreightatthehighestratepayableunderPartⅠFhereofforavoyagebetweentheloadinganddischargeportsusedbyCharterer.AllchargesnormallyincurredbyreasonofusingmorethanoneberthshallbeforCharterer'saccountasprovidedinClause9hereof.Timeconsumedshiftingbetweentheportsorterminalswithintheparticulargroupingorcombinationshallnotcountasusedlaytime.Timeconsumedshiftingbetweenberthswithinoneoftheportsorterminalsoftheparticulargroupingorcombinationshallcountasusedlaytime.两港或多港按一港计算参照本租船合同第一部分F项订明的运费率 ,在规定的港口或泊位的特殊集合或组合的范围内,每一集合或组合中的任何两个或多个港口或泊位应按一个港口或泊位计算运费和滞期费,并且符合下列条件:(1)承租人对其使用的装货港和卸货港之间的航程,应按第一部分F项订明的最高费率支付运费;(2)因使用一个以上泊位而通常发生的各种费用,应按第9条的规定由承租人承担;本船在特定集合或组合内的港口或泊位之间移泊所用时间,不应计为实用装卸时间;本船在特定集合或组合中的某一港口或泊位内移泊所用时间,应计为装卸时间。716.GENERALCARGO.TheCharterershallnotbepermittedtoshipanypackagedgoodsornon-liquidbulkcargoofanydescription;thecargotheVesselistoloadunderthischarteristoconsistonlyofliquidbulkcargoasspecifiedinClause1.16.普通货承运人不得装运任何种类的包装货或非液态散装货。本船根据本租船合同装载的货物应仅为第1条规定的液态散装货物。17.(a).QUARANTINE.ShouldtheCharterersendtheVesseltoanyportorplacewhereaquarantineexists,anydelaytherebycausedtotheVesselshallcountasusedlaytime;butshouldthequarantinenotbedeclareduntiltheVesselisonpassagetosuchport,theCharterershallnotbeliableforanyresultingdelay.(b).FUMIGATION.IftheVessel,priortoofafterenteringuponthisCharter,hasdockedordocksatanywharfwhichisnotrat-freeorstegomyia-free,sheshall,beforeproceedingtoarat-freeorstegomyia-freewharf,befumigatedbytheOwnerathisexpense,exceptthatistheChartererorderedtheVesseltoaninfectedwharftheCharterershallbeartheexpenseoffumigation.17.(1)检疫如承租人指示本船前往存在检疫期的任何港口或地点,因此造成本船的任何延误应计为实用装卸时间。但如在本船开始前往此种港口的航程之前检疫尚未宣告,则承租人对造成的任何延误不负责任。(2)熏舱如本船在开始履行本租船合同之前或之后已挂靠或挂靠有鼠害或黄热蚊的港口,则在其驶往无鼠害或黄热蚊的港口之前,船东应对其进行熏舱并承担费用,但如系承租人指示本船前往有疫情的港口,则由承租人承担熏舱费用。18.CLEANING.TheOwnershallcleanthetanks,pipesandpumpsoftheVesseltothesatisfactionoftheCharterer'sInspector.TheVesselshallnotberesponsibleforanyadmixtureifmorethanonequalityofoilisshipped,norforleakage,contaminationordeteriorationinqualityofthecargounlesstheadmixture,leakage,contaminationordeteriorationresultsfrom(a)unseaworthinessexistingatthetimeofloadingorattheinceptionofthevoyagewhichwasdiscoverablebytheexerciseofduediligence,or(b)errororfaultoftheservantsoftheOwnerintheloading,careordischargeofthecargo.清洗船东应清洗本船油舱、管路及油泵,直至承租人的检验人满意。如装运的油类品质超过一种,本船对因此产生的掺混不负责任,也不对货物渗漏、污染或变质负责,除非货物掺混、渗漏、污染或变质起因于(1)本船装货时或开始航行时存在经谨慎处理能发现的不适航,或者(2)船东的受雇人在货物装载、照管和卸载中有过错19.GENERALEXCEPTIONSCLAUSE.TheVessel,herMasterandOwnershallnot,unlessotherwiseinthisCharterexpresslyprovided,beresponsibleforanylossordamage,ordelayorfailureinperforminghereunder,arisingorresultingfrom:-anyact,neglect,defaultorbarratryoftheMaster,pilots,marinersorotherservantsoftheOwnerinthenavigationormanagementoftheVessel;fire,unlesscaused8bythepersonaldesignorneglectoftheOwner;collision,strandingorperil,dangeroraccidentoftheseaorothernavigablewaters;savingorattemptingtosavelifeorproperty;wastageinweightorbulk,oranyotherlossordamagearisingfrominherentdefect,qualityorviceofthecargo;anyactoromissionoftheChartererorOwner,shipperorconsigneeofthecargo,theiragentsorrepresentatives;insufficiencyofpacking;insufficiencyorinadequacyofpacking;insufficiencyorinadequacyofmarks;explosion,burstingofboilers,breakageofshafts,oranylatentdefectinhull,equipmentormachinery;unseaworthinessoftheVesselunlesscausedbywantofduediligenceonthepartoftheOwnertomaketheVesselseaworthyortohaveherproperlymanned,equippedandsupplied;orfromanyothercauseofwhatsoeverkindarisingwithouttheactualfaultorprivityoftheOwner.AndneithertheVesselnorMasterorOwner,northeCharterer,shall,unlessotherwiseinthisCharterexpresslyprovided,beresponsibleforanylossordamageordelayorfailureinperforminghereunder,arisingorresultingfrom:-ActofGod;actofwar;perilsoftheseas;actofpublicenemies,piratesorassailingthieves;arrestorrestraintofprinces,rulersorpeople;orseizureunderlegalprocessprovidedbondispromptlyfurnishedtoreleasetheVesselorcargo;strikeorlockoutorstoppageorrestraintoflaborfromwhatevercause,eitherpartialorgeneral;orriotorcivilcommotion.19.一般免责条款除本租船合同另有明文规定外,本船、船长和船东对下列原因引起或造成的任何灭失、损害、延误或不履行本合同均不负责:--船长、引航员、船员或其他船东受雇人在驾驶船舶或管理船舶中的行为、疏忽、不履行职责或故意行为;火灾,除非因船东本人设计或疏忽所致;碰撞、搁浅,或海上或其他通航水域的风险、危险或意外事故;救助或企图救助人命或财产,重量或体积的减少或其他因货物固有缺陷、质量或瑕疵引起的灭失或损害;承租人或货主、托运人或收货人、他们的代理人或代表的任何行为或不为;标志不充分或不当;锅炉爆炸;轴断裂或任何船体或船机的潜在缺陷;本船不适航,但因船东未尽谨慎处理使船舶适航,适当配备船员、装备船舶和配备供应品所致时除外;或者任何其他非船东实际过失或私谋引起的原因。除合同另有明文规定外,无论是本船或船长或船东,还是承租人,对下列原因引起或造成的灭失、损害、延误或不履行本合同,概不负责:--天灾;战争行为;海上风险、海盗或海上窃贼;君主、当权者或人民的扣押或拘禁;或依法扣押,但迅速提供担保使本船或货物得以获释;不论何种原因引起的局部或全面的罢工或闭工或停工或劳动制;暴动或骚乱。ISSUANCEANDTERMSOFBILLSOFLADINGTheMastershall,uponrequest,signBillsofLadingintheformappearingbelowforallcargoshippedbutwithoutprejudicetotherightsoftheOwnerandChartererunderthetermsofthisCharter.TheMastershallnotberequiredtosignBillsofLadingforanyportwhich,theVesselcannotenter,remainatandleaveinsafetyandalwaysafloatnorforanyblockadedport.20.提单的签发及条款船长应根据要求,对装船的货所有提单而进行的货物运输,应符合法律规定和本条下述第①至⑧项规定或按下列格式签发提单而不影响船东或承租人根据本租船合同条款具有的权利。对本船不能安全驶入、停留和驶离并始终浮泊的任何港口或任何被封锁的港口,不得要求船长签发提单。ThecarriageofcargounderthisCharterPartyandunderallBillsorLadingissuedforthecargoshallbesubjecttothestatutoryprovisionsandothertermssetforth9orspecifiedinsub-paragraphs(i)through(vii)ofthisclauseandsuchtermsshallbeincorporatedverbatimorbedeemedincorporatedbythereferenceinanysuchBillofLading.Insuchsub-paragraphsandinanyActreferredtotherein,theword"carrier"shallincludetheOwnerandtheCharteredOwneroftheVessel(2).根据本租船合同和为货物签发的载明的其他条款。此种条款应逐字并入此种提单或依此种提单中的揭示而视为并入此种提单。下述各项及其提到的法案中,“承运人”一词应包括船东和本船承租船东。
