Thefollowaretheconditionsandexceptionshereinbeforereferredto:                   1.DEFINTION.“Merchant”includestheShipper,theReceiver,theConsignor, theconsignee,the HolderoftheBillofLadingandtheOwneroftheGoods.2.JURISDICTION.AlldisputesarisingunderandinconnectionwiththisBillofLadingshallbesettledintheflag–stateoftheship,orotherwiseintheplacemutuallyagreedbetweentheCarrierandtheMerchant.3.PARAMOUNTCLAUSE.ThisBillofLadingshallbesubjecttotheHagueRulescontainedintheInternationalConventionfortheUnificationofCertainRulesoflawRelatingtoBillsofLading,datedatBrusselsthe25thAugust1924,orthecorrespondinglegislationoftheflagstateoftheship.IfthestipulationofthisBillofLadingarewhollyorpartlycontrarythereto,thisBillofLadingshallbereadasifsuchstipulationorpartthereof,asthecasemaybe,weredeleted.4.PERIODOF RESPONSIBILITY.TheresponsibilityoftheCarriershallcommencefromthetimewhenthegoodsareloadedonboardthevesselandshallceasewhentheyaredischargedfromthevessel.TheCarriershallnotbeliableforlossofordamagetothegoodsbeforeloadingandafterdischargingfromthevessel,howsoeversuchlossordamagearises.5.PACKINGANDMARKS.TheMerchantshallhavethegoodsproperlypackedandaccuratelyandclearlymarkedbeforeshipment.Theportofdestinationofthegoodsshouldbemarkedinlettersnotlessthan5cmhigh,insuchawayaswillremainlegibleuntiltheirdelivery,AllfinesandexpensesarisingfrominsufficiencyorinadequacyofpackingormarksshallbebornebytheMerchant.6.FEIGHTANDOTHERCHARGES.(1)Advancefreighttogetherwithotherchargesisdueon shipment.Ifnotprepaid.Thoughstipulated,thefreightandotherchargesshallbepaidbytheMer- chant plus5%interestperannumrunningfromthedateofnotificationfortheirpayment,Ifthecargo shippedareperishables,lowcostgoods,liveanimals,deckcargoorgoodsforwhichthereisno Carrier’sagentattheportofdestination,thefreightforsuchcargoandallrelatedchargesshallbepaidatthetimeofshipment.Freightpayableatdestinationtogetherwithotherchargesisdueonvessel’sarrival.Advancefreightand/orfreightpayableatdestinationshallbepaidtotheCarrierinfull,and non-returnableand non-deductableirrespectiveofwhateverlossordamagemayhappentovesselandcargooreitherofthem.(2)Alldues,taxesandchargesoranyotherexpensesinconnectionwiththegoodsshallbepaidbytheMerchant.7.INCORRECTSTATEMENT.TheCarrierisentitled,atportofshipmentand/orport ofdestination,toverifythequantity,weight,measurementand/orcontentsofsuchgoodsasdeclaredbytheMerchant.If theweight,measurementand/orcontentsofsuchgoodsasstatedintheBillofLadingturnedouttobe inconsistentwiththatofthegoodsactuallyloaded,andthefreightpaidfallsshortoftheamountwhich wouldhavebeendueifsuchdeclarationhadbeencorrectlygiventheCarrierisentitledtocollectfrom theMerchantasliquidateddamagestotheCarrierdoubletheamountofdifferencebetweenthefreight forthe goodsactuallyshippedandthatmisstated.TheMerchantshallbeliableforlossofanddamagetothevesseland/orgoodsarisingorresultingfrominaccuraciesinstatingthedescription,quantity,weight,measurementorcontentsofthegoodsandshallindemnifytheCarrierforthecostsandexpensesinconnectionwithweighing,measuringandcheckingsuchgoods.8.LOADING,DISCHARGINGANDDELIVERY.Thegoodsshallbesuppliedand takendeliveryofbytheOwnerofthegoodsasfastasthevesselcantakeanddischargethem,withoutinterruption,bydayandifrequiredbyCarrieralsobynight,Sundaysandholidaysincluded,notwithstandinganycustomoftheporttothecontraryandtheOwnerofthegoodsshallbeliableforalllossesordamagesincludingdemurrageincurredindefaultthereof.Dischargemaycommencewithoutpreviousnotice,IfthegoodsarenottakendeliveryofbytheReceiverfromalongsidethevesselwithoutdelay,oriftheReceiverrefusestotakedeliveryofthegoods,orincasethereareunclaimedgoods,theCarriershallbeatlibertytolandsuchgoodsonshoreoranyotherproperplacesatthesoleriskandexpenseoftheMerchant,andtheCarrier’sresponsibilityofdeliveryofcargoshallbedeemedtohavebeenfulfilled.WeighingonboardisonlyallowedbyspecialpermissionoftheCarrier,includingdetentionandextracostsofdischarging,shallbeforaccountoftheReceiversorConsignees,notwithstandinganycustomoftheporttothecontrary.Ifthegoodsareunclaimedduringareasonabletime,orwhereverthegoodswillbecomedeteriorateddecayedorworthless,theCarriermay,athisdiscretionandsubjecttohislien,andwithoutanyresponsibilityattachingtohim,sell,abandonorotherwisedisposeofsuchgoodssolelyattheriskandexpenseoftheMerchant.9.LIGHTERAGE.,Anylighterageinoroffportsofloadingorportsofdischargeshallbefortheccountof theMerchant.10..LIEN.TheCarriershallhavealienonthegoodsandanydocumentrelating theretoforfreight,dead freight,demurrageandanyotheramountpayablebythe Merchant,andforGeneralAveragecontributions forwhomsoeverdueandforthecostofrecoveringthesame,andforthispurposeshallhavetherightto sellorotherwisedisposeofthegoods.Ifonsaleofthegoods,theproceedsfail tocovertheamountdueandthecostandexpensesincurred,theCarriershallbeentitledtorecoverthedeficitfromtheMerchant.11.NOTICEOFLOSSORDAMAGE,THIMEBAR.Unlessnoticeoflossor damageandthegeneral natureofsuchlossordamagebegiveninwritingtothe Carrierorhisagentattheportofdischargebeforeoratthetimeoftheremovalofthe goodsintothecustodyofthepersonentitledtodelivery thereofunderthecontactof carriage,suchremovalshallbeprimafacieevidenceofthedeliveryby theCarrierof thegoodsasdescribedintheBillofLading.Ifthelossordamageisnotapparent, thenoticemustbegivenwithinthreedaysofthedelivery.Thenoticeinwritingneednotbegivenifthestateofthegoodshasatthetimeoftheirreceiptbeen thesubjectofjointsurveyorinspection.Inanyeventthecarrierandthevesselshallbedischargedfromallliabilityinrespectoflossordamageunlesssuitisbroughtwithinoneyearafterdeliveryofthegoodsorthedatewhenthegoodsshouldhavebeendelivered.InthecaseofanyactualorapprehendedlossordamagetheCarrierandtheReceivershallgiveallreasonablefacilitiestoeachotherforinspectingandtallyingthegoods.12.LIMITATIONOFLIABILITY.AllclaimsforwhichtheCarriermaybeliableshallbe calculatedonthebasisoftheMerchant’snetinvoicecost,plusfreightand insurrancepremuim, ifpaid.InnoeventshalltheCarrierbeliableforanylossofpossibleprofitoranyconsequential loss.TheCarrierforanylossofordamagetothegoodsshallbelimitedtoanamountnotexceeding£100perpackageorfreightunitunlessthevalueofthegoodshigherthantheamountisdeclaredinwritingbytheShipper beforereceiptofthegoodsbytheCarrierandinsertedinthisBillofLadingandextrafreightpaidasrequired.Iftheactualvalueofthegoodsperpackageofperfreightunitexceedssuchvalue,thedeclaredvalueshallneverthelessbedeemedtobethedeclaredvalueandtheCarrier’sliabilityifany,shallnotbethedeclaredvalueandanypartiallossordamageshallbeadjustedprorataonthebasisofsuchdeclared value.13.FORWARDING,SUBSTITUTEOFVESSEL,THROUGHCARGOANDRANSHIPMENT.If necessary,theCarriershallbeatlibertytocarrythegoodsto theirportofdestinationbyothervesselor vesselseitherbelongingtotheCarrierorotherpersonsorbyrailorothermeansoftransportproceeding eitherdirectlyorindirectlytosuchportandtocarrythegoodsorpartofthembeyondtheirportof destination,andtotranship,lighter,landandstorethegoodsonshoreorafloat andreshipandforward sameattheCarrier’sexpensesbutatMerchant’srisk.TheresponsibilityoftheCarriershallbelimitedto thepartofthetransportperformedbyhimonthevesselunderhismanagement.14.DANGEROUSGOODS,CONTRABAND.(1)TheMerchantundertakesnottotenderfortransportation anygoodswhichareofadangerous,inflammable,radio-active,and/oranyharmfulnaturewithout previouslygivingwrittennoticeoftheirnaturetotheCarrierandmarkingthegoodsand thecontaineror othercoveringontheoutsideasrequiredbyanylawsorregulationswhichmay beapplicableduring thecarriage.(2)Wheneverthegoodsarediscoveredtohavebeenshippedwithoutcomplyingwiththesubclause1aboveorthegoodsarefoundtobecontrabandorprohibitedbyanylawsorregulationsoftheportofloading,dischargeorcalloranyplaceorwatersduringthecarriage,theCarriershallbeentitledtohavesuchgoodsrenderedinnocuous, thrownoverboardordischargedorotherwisedisposedofattheCarrier’sdiscretionwithoutcompensationandtheMerchantshallbeliableforandindemnifytheCarrieragainstanykindofloss,damageorliabilityincludinglossoffreight,andanyexpensesdirectlyor indirectlyrisingoutoforresultingfromsuchshipment.(3)Ifanygoodsshippedcomplyingwiththesub-clause(1)abovebecomeadangertotheshiporcargo,theymayinlikemannerberenderedinnocuous,thrownoverboardordischargedorotherwisedisposedofattheCarrier’sdiscretionwithoutcompensationexcepttoGeneralAverage,ifany.15.DECKCARGO,LIVEANIMALSANDPLANTS.Cargoondeck,plantsandliveanimalsarereceived, handled,carried,keptanddischargedatMerchant’sriskandtheCarriershallnotbeliableforlossthereofordamagethereto.16.CARGOINCONTAINERS.(1)GoodsmaybestowedbytheCarrierorhisagents orservantsincontainersandcontainerswhetherstowedaforesaidorreceivedfully stowedmaybecarriedonorunderdeckwithoutnotice.TheCarrier’sliabilityfor suchcarriageshalllikewisebegoverned bythetermsandconditionsofthisBillof LadingirrespectiveofClause15hereofnotwithstandingthefactthatthegoodsare beingcarriedondeckandthegoodsshallcontributetoGeneralAverageandshall receivecompensationinGeneralAverage.(2)Ifacontainerhasnotbeenfilled, packed,stuffed orloadedbytheCarrier,thecarriershallnotbeliableforlossofordamagetothecontents andtheMerchantshallindemnifytheCarrieragainstany injury,loss,damage,liabilityorexpenseincurredby theCarrierifsuchinjury,loss, damage,liabilityorexpensehasbeencausedby:1) themannerinwhichthecontainerhasbeenfilled,packed,stuffedorloaded;or2) theunsuitabilityofthecontentsforcarriageincontainers;or3)theunsuitabilityordefectiveconditionofthecontainerwhichwouldhavebeen apparentupon reasonableinspectionbytheMerchantatorpriortothetimethe containerwasfilled,packed,stuffedorloaded.Ifacontainerwhichhasnotbeenfilled,packed,stuffedorloadedbytheCarrierisdelivered by theCarrierwiththesealintact,suchdeliveryshallbedeemedasfullandcompleteperformanceof theCarrier’sobligationhereunderandtheCarriershallnotbeliableforanylossofordamagetothecontentsofthecontainer,TheShippershallinspectcontainersbeforestuffingthemandtheuseofthecontainersshallbe primafacieevidenceoftheirbeingsoundandsuitableforuse.17.REFRIGERATEDGOODS.Beforeloadinggoodsinanyinsulatedspace,theCarriershall,inadditionto theClassCertificate,obtainthecertificateoftheClassificationSociety’sSurveyoror othercompetent   person,statingthatsuchinsulatedspaceandrefrigeratingmachineryareintheopinionofthesurveyororothercompetentpersonfitandsafeforthecarriageandpreservationofrefrigeratedgoods,Theaforesaid certificateshallbeconclusiveevidenceagainsttheMerchant.Receivershavetotakedeliveryof refrigeratedcargoassoonasthevesselisreadytodeliver,otherwisetheCarriershalllandthegoodsatthewharfattheMerchant’sriskandexpense.18.TIMBER.AnystatementinthisBillofLadingtotheeffectthattimberhasbeen shipped“Inapparentgoodorderandcondition”doesnotinvolveanyadmissionby theCarrierastothe absence ofstains,shakes,splitsholesorbrokenpieces,forwhichtheCarrieracceptsno  responsibility.19.IRONANDSTEEL.EverypieceofIronandSteelistobedistinctlyand permanentlymarkedwithoil paintandeverybundlesecurelyfastened,distinctly andpermanentlymarkedwithoilpaintandmetal tagged,bytheMerchant,sothat eachpieceorbundlecanbedistinguishedatportofdischarge.If theMerchantfails tomeettheaforesaidrequirements,theCarrier,shallneitherberesponsiblefor correctdeliverynorliableforexpensesarisingtherefrom.20.BULKCARGO,GOODSTOMORETHANONECONSIGNEE.(1)AstheCarrierhasnoreasonable meansofcheckingtheweightofbulkcargo,anyreferencetosuchweightinthisBillofLadingshallbedeemedtobeforreferenceonly,butshallconstituteinnowayevidenceagainsttheCarrier(2)WherebulkCargoorgoodswithoutmarksorcargowiththesamemarksare shippedtomorethanoneConsignee,theConsigneesorownersofthegoodsshall jointlyandseverallybearanyexpenseorlossindividingthegoodsorparcelsintoprorataquantitiesandanydeficiencyshallfallupontheminsuchproportionastheCarriers,hisservantsoragentsshalldecide.21.HEAVYLIFTSANDAWKWARDCARGO.Anyonepieceorpackageofcargoweighs2000kilosorupwardsandanyawkwardcargowithalengthof9metersorupwardsmustbeclearlyandboldly marked withtheweightand/ordimensionsand/orlengthbytheShipperandshallbeloadedanddischargedby shorecraneorotherwiseattheship’soptionandattheriskandexpenseoftheMerchant.Ifanydamage,lossorliabilitytotheship,lighter,wharf,quay,cranes,hoistingtackle,orwhatsoeverortowhomsoever occursowingtothelackofstatementormis–statementofweight,measurementorlength,theMerchantshallberesponsibleforsuchdamage,lossorliability.22.FUMIGATION.Intheeventoffumigationofgoodsonboardforwhateverreason,theCarriershall notbeliablefordamagetogoodswithoutactualproofoftheCarrier’snegligencewhich shall notbepresumedagainsthim,andallexpensesincurredareforMerchant’saccount.23.OPTION.Theportofdischargeforoptionalgoodsmustbedeclaredtothevessel’sagentsatthefirstof theoptionalportsnamedintheoptionnotlaterthan48hoursbeforethevessel’sarrival there. IntheabsenceofsuchdeclarationtheCarriermayelecttodischargeatthefirstoranyoptionalport and thecontractofcarriageshallthenbeconsideredashavingbeenfulfilled.Any   optionmust befor thetotalquantityofgoodsunderthisBillofLading.24.GENERALAVERAGEANDNEWJASONCLAUSE.(1)Generalaverageshallbeadjusted. Stated and settledaccordingtotheYork–AntwerpRulos,1974,atanyportorplaceatthe carrier’soption.Intheeventofaccident,danger,damageordisasterbeforeorafterthecommencementwhich,orforthe consequenceofwhichtheCarrierisnotresponsible,bystatutecontractorotherwise, thegoods,Shippers,ConsigneesorOwnersofthegoodsshallcontributewiththeCarrierinGeneralAveragetothepaymentofanysacrifices,lossesorexpensesofaGeneralAveragenaturethatmaybemadeorincurredandshallpaysalvageandspecialchargesincurredinrespectofthegoods,IfasalvingshipisownedoroperatedbytheCarrier,salvageshallbepaidforasfullyasifthesaidsalvingshiporshipsbelongedtostrangers.Such depositastheCarrierofhisagentsmaydeemsufficinttocovertheestimatedcontributionofthegoods,andanysalvageandspecialchargesthereonshall,ifrequired,bemadebythegoods,Shippers,Consignees orOwnersofthegoodstotheCarrierbeforedelivery.25.BOTHTOBLAMECOLLISIONCLAUSE.Ifthevesselcomesintocollisionwithanothervesselasaresultofthenegligenceoftheothervesselandanyact,neglectordefaultofthemaster, mariner,pilotoroftheservantsoftheCarrierinthenavigationorinthemanagementofthe vessel,the ownersofthegoodscarriedhereunderwillindernmifytheCarrieragainstalllossorliabilitytotheother ornon-carryingvesselorherOwnersinsofarassuchlossorliabilityrepresentslossofordamagetooranyclaimwhatsoeveroftheOwnersofsaidgoodspaidor payablebytheotherornon-carryingvesselorherOwnerstotheOwnersofsaidgoodsandsetoff, recoupedorrecoveredby theotherornon-carryingvesselorherOwnersaspartoftheirclaimagainst thecarryingshiporCarrier.TheforgoingprovisionsshallalsoapplywheretheOwners,operatorsorthosein chargeofanyvesselorvesselsorobjectsotherthan,orinadditionto,thecollidingvesselsorobjectsareatfaultinrespectofacollision,contactstrandingorotheraccident.26.WAR,QUARANTINE,ICE,STRIKES,CONGESTIONETC.Shoulditappearthatwar, blockade, pirate,epidemics,quarantine,ice,strikes,congestionandothercausesbeyondthe Carrier’scontrol wouldpreventthevesselfromsafelyreachingtheportofdestinationand/or dischargingthe goods thereat,theCarrierisentitledtodischargethegoodsattheportofloading  oranyothersafe and convenientportandthecontractofcarriageshallbedeemedtohavebeen fulfilled.Anyextra expensesincurredundertheoforasaidcircumstancesshallbebornebytheMerchant.
