合用于一方当事人(乙方)以技术知识为另一方(甲方)解决特定技术问题所订立的合同。三、签约一方为多个当事人的，可按各自在合同关系中的作用等，在“甲方”、“乙方”项下(增页)分别排列为共同委托人或共同受托人。四、本合同书未尽事项，可由当事人附页另行约定补充协议，并作为本合同的组成部分。五、当事人使用本合同书时约定无需填写的条款，应在该条款处注明“无”等字样。六、合同条款中的蓝色标明为选项，做出选择后应该删除未选择的部分。七、如有必要，可另行签署保密协议。masslineofthepartyconstructionofeducationsystem,improvescientificandsystematizationandstandardizationlevelofthepartybuilding.Withafocusontheconstructionofdemocraticcentralismandcontinuethetraditionofinner-partydemocracy,openchannels,andfullplaytothepeople'sCongress,theCPPCC'sroleindemocraticdecision-making,andconstantlyraisethelevelofscientificdecision-makingintheparty.Toparty'smasslineineducationalpracticesofvarioussystemsestablishedandimplementedasanopportunitytostrengthenpartyleadershipandpartybuilding,enhancingtherallyingpowerandcombatcapabilityoftheleadershipteam.Continuetodeepenthereformofthecadreandpersonnelsystem,alwaysadheretocorrectdirectionofpersonnel,implementregulationsoncadreselection根据《中华人民共和国合同法》规定，为明确甲乙双方的权利、义务和经济责任，双方本着同等互利的原则，经友好磋商，订立本合同并完成以下协议及条款:一、合同范围乙方为甲方提供CDMA移动执法车监控系统和与系统有关系的所有硬件、软件提供保质期外的检修保养服务。二、主要内容(一)系统中设备的故障响应。故障响应:乙方在接到甲方电话或书面的检修通知后，必须指定技术人员市区2小时、市区以外5小时内抵达故障现场。(二)系统中设备破坏后的修复和改换。故障修复:后端软件平台3小时内修复、执法车前端设备4小时内修复、重要事故(执法车不能正常工作)24小时内修复(以上时间均包括响应时间在内)。修复后必须由甲方有关人员确认。设备改换:在故障现场不能修复的设备，乙方为了应急修复所用的设备在征得甲方同意后方可改换，有关费用与甲方另行结算，改换后的破坏件应交由甲方查验。甲方若需改换有关设备及其配件，预先要与乙方技术人员交流确认无异议后方可进行改换，乙方有义务对甲方错误进行指正。(三)系统保养和维护。执法车摄像机保养:乙方起码贰月1次对摄像机表面进行清洁、除垢，时间为每个月的15号，遇雨天或周末等顺延。执法车主要设备保养:乙方起码贰月1次对执法车主要设备进行详尽检测，时间为每个月的15号，遇雨天或周末等顺延。系统保养:乙方起码每半年各进行壹次对执法车系统进行全面的检测保养，时间为每年4月和9月的第一个星期。masslineofthepartyconstructionofeducationsystem,improvescientificandsystematizationandstandardizationlevelofth第3页共6页epartybuilding.Withafocusontheconstructionofdemocraticcentralismandcontinuethetraditionofinner-partydemocracy,openchannels,andfullplaytothepeople'sCongress,theCPPCC'sroleindemocraticdecision-making,andconstantlyraisethelevelofscientificdecision-makingintheparty.Toparty'smasslineineducationalpracticesofvarioussystemsestablishedandimplementedasanopportunitytostrengthenpartyleadershipandpartybuilding,enhancingtherallyingpowerandcombatcapabilityoftheleadershipteam.Continuetodeepenthereformofthecadreandpersonnelsystem,alwaysadheretocorrectdirectionofpersonnel,implementregulationsoncadreselection执法车应用终端:执法车服务器端软件、执法车客户端软件,GIS定位软件故障清除及恢复、病毒防范及除去、硬盘垃圾清理、电脑外设安装调试、系统安装调试与维护、应急、系统恢复及平时维护等。其余保养:对执法车摄像机支架、标示等设备的破坏和自然锈迹在必要时进行修复和表面翻新。在“执法车移动视频系统”有迁移必要时进行迁移。以及其余未罗列有关设备的保养。(四)系统改造和升级的建议。对移动执法车系统具备提高硬件、软件性能技术条件的时候，乙方将负责执法车系统的平滑过渡。对中国电信3G业务平台推出后，在支持CDMA的3G移动视频终端面世，运行性能稳定后，乙方将按照低于市场价钱平滑过渡CDMA移动执法车到3G。对软件平台升级、迁移工作，乙方将经过跟甲方的友好磋商，根据实际内容的大小确定后续工作。(五)用户操作人员的培训。对甲方提出的CDMA移动执法车操作培训要求，乙方将根据甲方的实际需求，积极配合甲方的工作，定期组织有关培训。三、责任义务乙方必须配备检修、保养工作所必须的交通工具，检测设备、仪器仪表，对系统所需的所有配件须常年备货。乙方必须成立一支有有关知识组成的专业技术队伍，提供7*7*24服务，并将有关人员的通讯方式见告甲方。乙方必须向甲方提交详尽的工作
