lityforoverduepaymentIfthebuyercannoteffectthepaymentinthestipulatedtime,heorshewillbetreatedinthe2ndmode:Iftheoverduedateiswithin__days,fromthe2duepaymentdatetotheactualpaymentdate,thebuyershouldpaytotheseller%_defaultfineaccordingtotheoverduedate,thecontractwillcontinuetobeperformed.Iftheoverduedateisexceeds__days,thebuyerhastherightstoterminatethecontract.Ifso,thebuyershouldpaytotheseller%_defaultfineaccordingtotheoverduedate,thecontractwillcontinuetobeperformed,fromthe2duepaymentdatetotheactualpaymentdate,thebuyershouldpaytothesellerdefaultfineaccordingtotheoverduedate.Theoverduepaymentinthisarticlereferstothebalancebetween6articleduepaymentandacutaleffectedpayment;forinstallmentpayment,itshouldbedecidedbythebalancebetweendueistallmentandactualpayment.Article8handoverdeadlineAccordingtothestate'©ndlocalgovernmentregulations,thesellershouldhandoverthecommercialresidentialbuilding,whichpossessthebelow1conditions,asstipulatedbythecontract,tothebuyerbeforeMAY,31,2011thiscommercialresidentialbuildingisinspectedtobequalified.thiscommercialresidentialbuildingiscomprehensivelyinspectedtobequalified.thiscommercialresidentialbuildingisinstallmentinspectedtobequalified.4.thiscommercialresidentialbuildingobtainedtheapprovaldocumentsofcommercialresidentialhandoverforusage.5.Butincaseofthefollowingexceptionalreasons,exceptforbothpartiesagreetheterminationoralternationofcontract,thesellercanprolongthedeadlineasperactualfact.encounteredwithmajeure,andsellerinformedthebuyerwithin30daysafterthemajeureoccurs;thesellercausedtheprojectcannotbefinishedontimebecauseofnon-controllablereasons.Ifthedelayisbecauseoftheabovecases,thisarticleisalsoapplicable.Article9responsibilityofdelayinhandoverapartmentExceptforthespecialcasesstipulatedinarticle8,ifthesellercannothandovertheapartmenttobuyerinthestipulatedscheduleinthiscontract,thebuyershouldbetreatedinthefollowing1st&2mode:Accordingtotheoverduetime,thesellershouldbetreatedseparately(notbeaccumulated)Foroverduedatelessthan90days,fromthe2ddayofdeadlinestipulatedinarticle8tothepaymentday,thebuyershouldpay%defaultfineofthealreadyeffectedpayment,thiscontractwillbeperformedcontinuously.Foroverduedatemorethan90days,thebuyercanterminatethecontract.Inthiscase,thesellershouldreturnallthepaymentwithin30daysafterthedateoftermination,andpay_2%defaultfineofthealreadyeffectedpayment.Ifthebuyerrequestcontinuouslyperformthecontract,thiscontractwillbeperformedcontinuously.fromthe2nddayofdeadlinestipulatedinarticle8tothepaymentday,thesellershouldpaythebuyer0.02%(thisratiocannotbelessthantheratesin1))ofthealreadyeffectedpaymentArticlelOagreementontheplanning&designingvariationTheplanning&designingvariationagreedbygovernmentordesigningOrganization,whichaffectsthecommercialresidentialqualityandusageofbuyer,thesellershouldsendwrittennotificationtothebuyerwithin10daysaftertheapprovalupontherelatedorginazation:theconstruction,layout,spacedimension,orientation;Thebuyerhastherightstoreplyinwrittenwordsregardingwhethertocanceltheorderwith15daysafterreceivingthenotice.Ifthebuyerdidn'canceltheorderwith15daysafterreceivingthenotice,itwillberegardedasacceptancetothevariation.Ifthesellerhaven'noticedthebuyerwithinstipulatedtime,thebuyerhasrightstocanceltheorder.Ifthebuyercanceltheorder,thesellermustreturntheeffectedpaymentwithindaysaftertherequestismade,andalsopaytheinterestsaccordingto%Ifthebuyerdon'canceltheorder,heorsheshouldsignsupplementaryagreementwiththeseller.Article11handoverWhentheresidentialmeettheusagecondition,thesellershouldsendwrittennotificationtothebuyertomakehandoverprocedure.Duringthehandover,thesellermustissuetheproofdocumentsstipulatedinarticle8,andsigntheresidentialhandoversheet.Fortheresidentialwhichbelongstohabitation,theselleralsoneedtoprovidethe[habitationqualityguarantee]and[habitationusageinstructions].Ifsellerfailstoissuetheabovedocumentsorissueincompletedocuments,thebuyerhasrightstorefuseacceptingthehandover,delaycausedbythiscasewillbeintheseller'account.Forthedelayhandovercausedbythebuyer,bothpartiesagreedtomanageasbelow:Article12sellermustensuretheresidentialsoldwithoutpropertyrights&creditor'srightdisputes.Unabletomakepropertyrightsregistrationoroccuraneeindisputes,theresponsibilitymustbebornbytheseller.Buyermustensuretheinstallmentpaymentdocumentswithauthenticity.Thelosscausedbyfakeddocumentsfromthebuyer,theresponsibilitymustbebornbythebuyer.Article13seller'promiseonbreachofDecorativeequipmentstandardsThedecorativeequipmentstandardshandoveredbythesellershouldmeetthestandardagreedbybothpartiesinarticle3.Ifnotachievethestandard,thebuyerhastherightstomanageaccordingtothefollowingmode.1thesellercompensatethedecorativeequipmentindoublebalanee.3Article14promiseofselleronthenormalusageofinfrastructure,affiliatedequipmentsThesellerpromisethefollowinginfrastructure,affiliatedequipmentsdirectlyrelateswiththenormalusageofthisresidentialachievetheusageconditionaccordingtothebelowdate:theinitialassemblingoftelephoneline,CCTVlinenetworklineshouldbeeffectedbythebuyer.conditionwithin30dayafter
