职工带薪年休假条例(英文版)国务院令[2007]第514号2007年12月14日AnnouncementoftheStateCouncilontheRegulationsofPaidAnnualLeaveofEmployeesOrderoftheStateCouncil[2007]No.514December14,2007TheRegulationsofPaidAnnualLeaveofEmployeesadoptedatthe198thGeneralMeetingoftheStateCouncilonDecember7,2007areherebypromulgatedandshallbeeffectiveasofJanuary1,2008.Primer:WenJiabao,Appendix:RegulationsofPaidAnnualLeaveofEmployeesArticle1TheseRegulationsareformulatedinaccordancewiththeLaborLawandthePublicServantsLawinordertoprotecttherightstorestdaysandannualleaveofemployeesanddeployemployeestoactivelydischargetheirduties.Article2Theemployeesofunitssuchasauthorities,organizations,enterprises,institutions,privatenon-enterpriseunitsandindividually-ownedcommercialandindustrialbusinesseswithemployeesthathavebeenworkedcontinuouslyformorethanoneyearareentitledtopaidannualleave(hereinafterreferredtoas"annualleave").Unitsshallguaranteethatemployeesareentitledtoannualleave.Employeestakingannualleaveareentitledtothewagesofanormalworkingday.Article3Whereanemployeehasservedonefullyearbutlessthan10yearsaccumulatively,heisentitledtofivedaysofannualleave.Ifhehasserved10fullyearsbutlessthan20years,annualleaveis10days.Ifhehasservedfor20fullyears,annualleaveis20days.Article4Anemployeeisnotentitledtoannualleaveforthecurrentyearifheisunderanyofthefollowingcircumstances:1.Theemployeeisentitledtosummerandwintervacationsinaccordancewiththelawandthenumberofdaysofsuchvacationsismorethanthatofhisannualleave;2.Theemployeehastakenmorethan20daysofcasualleaveaccumulativelyandhisunitdoesnotdeductwagesinaccordancewithprovisions;3.Theemployeehasservedonefullyearaccumulativelybutlessthan10yearsandhastakenmorethantwomonthsofsickleaveaccumulatively;4.Theemployeehasserved10fullyearsaccumulativelybutlessthan20yearsandhastakenmorethanthreemonthsofsickleaveaccumulatively;5.Theemployeehasservedmorethan20fullyearsandhastakenmorethanfourmonthsofsickleaveaccumulatively.Article5Unitsshallcoordinateandarrangefortheannualleaveofemployeesonthebasisofthespecificconditionsofproductionandworkandtheindividualpreferenceofemployees.Annualleavemaybecentrallyarrangedwithinoneyear or inseveralperiodsanddoesnotspanmorethanoneyearingeneral.Unitsmaymakesucharrangementthatspansmorethanoneyeariftheyhaveagenuineneedforsucharrangementduetoproductionandjobspecialties.Unitsthatcannotarrangeforannualleaveforemployeesduetojobrequirements,theymaynotarrangeforannualleavewiththeconsentofsuchemployees.Inrespectoftheannualleavethatshouldhavebeentakenbutotherwise,unitsshallpaywageremunerationtosuchemployeesattherateof300%ofthedailywageincomeofsuchemployees.Article6Thepersonneldepartmentandthelaborsecuritydepartmentofpeople'sgovernmentsatthecountylevel or aboveshallactivelyconductsupervisionandexaminationontheimplementationoftheseRegulationsbyunitsinaccordancewiththeirauthority.Labororganizationsshallprotecttherightstoannualleaveofemployeesinaccordancewiththelaw.Article7WhereaunitfailstoarrangeforannualleaveforemployeesandpaywageremunerationonannualleaveinaccordancewiththeRegulations,thepersonneldepartment or thelaborsecuritydepartmentofpeople'sgovernmentsatthecountylevel or aboveshallorderrectificationwithinatimelimit.Ifnorectificationismadewithinthetimelimit,suchunitshallbeorderedpaymentofwageremunerationonannualleaveandalsomakeadditionalcompensationtoemployeesonthebasisoftheamountofthewageremunerationofannualleave.Wherenowageremunerationonannualleave or compensationismade,andthepersonnelofsuchunitsarepublicservants or administeredwithreferencetothePublicServantsLaw,theperson-in-chargethatisdirectlyresponsibleandotherdirectlyresponsiblepersonnelshallbepunishedinaccordancewiththelaw,ifsuchunitbelongstoothercategories,thelaborsecuritydepartment,thepersonneldepartment or theemployeeshallapplyforcompulsoryimplementationbyapeople'scourt.Article8Whereemployeesandunitshavedisputeoverannualleave,itshallbedealtwithinaccordancewiththerelevantlawsandadministrativeregulationsofthestate.Article9ThepersonneldepartmentoftheStateCouncilandthelaborsecuritydepartmentoftheStateCouncilshallformulateimplementingproceduresoftheRegulationsrespectivelyinaccordancewiththeirrespectiveauthority.Article10TheRegulationsshallbeeffectiveasofJanuary1,2008
