的实际施工特点，经双方协商一致，在平等互利，完全自愿的前提下，就******配电工程母线槽、插接箱、始端箱采购事宜达成如下合同条款，以便双方共同遵守。第一条设备名称厂家、品牌及单价概况1.1插接母线槽、连接器、插接箱、始端箱、支架等全部材料价格均为含税价及材料费、保险费、装卸费、检验、运费。1.2母线数量以现场安装实测为准，始端箱内长度计算以实际铜排进箱长度为准。1.3如有设计更改，双方方有权根据图纸及现场安装实测进行数量增减。1.4母线外壳钢板厚度为1.5mm，应在国标允许负差之内；（具体材料单价详见后附清单）。第二条制造检测标准乙方保证该设备是严格按照现行国家标准、行业标准制造生产的，并提供出厂有效检验合格证书壹份。第三条包装乙方提供的产品包装需一次性包装，该包装应适于长途运输，有成套设备保护作用，并能有效防止雨淋和重压。第四条设备的运输和保险4.1乙方负责设备（材料、配件）到达甲方指定地点的一切运输，到达指定地点并负责卸货。4.2乙方负责设备运至甲方指定地点的运输过程中货物保险，设备运到甲方指定地点入库前设备的毁损、灭失风险均由乙方承担。第五条交货5.1交货时间：甲方提前通知，乙方接到甲方书面通知之日起15个工作日内交付设备。5.2交货地点：甲方指定唯一地点（工地现场或指定仓库）。5.3交货方式：乙方以汽车运输或火车运输送到甲方指定地点，运费由乙方承担。第六条检验、安装调试及验收6.1设备运至甲方指定地后，甲方有权对设备的生产厂家、产地、品牌、型号、规格及数量进行常规的检验清点，如经检验甲方发现设备与合同约定不符，甲方有权依据合同第十三条要求乙方承担违约责任。6.2母线槽、插接箱、始端箱、支架等乙方提供成套设备及材料并负责现场的丈量、线路优化，待货到后并派专业技术人员进行安装技术指导且保证能一次通过竣工验收。6.3甲方须提前七天通知乙方调试和试运行的到场时间，乙方接到通知后提前做好各项调试及试运行准备工作，调试期间由甲方、业主、监理方在场监督。乙方不得延迟，否则乙方应按300元/小时向甲方支付违约金；延迟达一天以上，违约金为2000元/日。6.4乙方负责在安装调试完成后配合甲方进行检测部门对设备质量的验收，并保证一次性通过验收，以检测部门出具的验收合格证明作为验收合格的最终证明，经验收，如发现设备存在质量问题，甲方有权依据本合同第十条要求乙方承担违约责任。6.5乙方应按照甲方施工进度，对母线槽、插接箱、始端箱进行指导施工安装。乙方不得延误工期，否则乙方应按500元/天向甲方支付违约金；延误达五天以上（含五天），按2000元/日向甲方支付违约金。第七条付款条件7.1本合同无预付款；7.2全部材料及设备进场经甲方检验合格入库后五个工作日内，甲方向乙方支付设备总价的30%；7.3所有设备安装调试合格并通过检测部门整体（本工程的供电系统）验收合格出具检测合格证书后五个工作日内，甲方向乙方支付设备总价的70%；7.4待工程整体竣工验收后，以验收 为准，20日内支付至设备总价款的95%7.5剩余5%作为质保金，于设备经检测部门验收合格期满两年且设备无质量问题后一个月内付清。7.6乙方接受银行转帐或承兑方式收款。7.7乙方提供正规税票。第八条质量保证8.1质量保证期：自本工程经检测部门验收合格之日起免费保修两年（24个月）。8.2乙方应保证其提供的货物是全新的，未使用过的，并在各个方面符合合同规定的质量、规格和性能。乙方应保证其货物经正确的安装、正常操作和保养在货物寿命期内运转良好。在乙方承诺的质量保证期内，乙方应对由于设计、工艺或材料的缺陷而发生的任何缺陷或故障负责，并承担相应的费用。8.3乙方保证严格按照现行国家标准或相应的质量管理和质量保证体系，对所供设备的设计、采购、制造、检验、涂装、包装、运输、装卸、就位、安装、调试等各个环节进行严格的质量管理和质量控制。8.4质保期内的承诺：在上述质保期内，任何因产品质量问题造成的故障均由乙方负责，乙方提供售后服务部联系人：，手机号码：，同时乙方承诺：在接到甲方报修通知后六（6）小时内派技术人员到达现场，排除故障，免费提供质量“三包”服务（包修、包退、包换）。8.5质保期外的售后服务：乙方继续负责设备的终身维修与保养，乙方在接到甲方报修通知后六（6）小时内派技术人员到达现场，及时解决有关技术问题，收取工本费。第九条不可抗力9.1甲乙双方任何一方因法律规定的不可抗力事故的影响而不能执行合同时，履行合同的期限应予以延长，延长的期限应相当于事故所影响的时间。9.2受阻一方应在不可抗力事故发生后当天24小时内通知对方，并提供事故发生地政府当局或有关部门出具的书面证明文件。9.3若不可抗力事故影响持续超过15天的，双方可友好协商解除合同，乙方应退还甲方所付款项。第十条违约责任10.1非因不可抗力原因，乙方逾期交货的，每逾期一（1）天，按设备总价的千分之五（5‰）支付违约金，并承担因此造成甲方的经济损失。10.2设备生产厂家、产地、品牌、规格型号、数量及质量未达合同约定要求的，如甲方同意利用，应当按质论价；如甲方不同意利用，应根据设备的具体情况及甲方要求，由乙方包换、包修（直至符合合同约定要求）或包退，并承担因修理、调换或退货而支付的实际费用。如在甲方提出维修或更换要求后三（3）天内，乙方仍未完成维修或调换的，按不能交货处理。10.3如乙方未能在第8.4款中承诺的时间内到达甲方现场进行维修等服务，应向甲方支付违约金，每延迟一小时，支付人民币100元，同时有权将设备交由其他维修单位维修，由此产生的费用及甲方因此所受的经济损失均由乙方承担。10.4非因不可抗力原因甲方逾期付款，每逾期一（1）天，按逾期支付货款的千分之三（3‰）支付违约金。第十一条提前解除合同条款乙方逾期交货超过十（10）天（含十天），视为不能交货。乙方不能交货的，甲方有权解除合同，并要求乙方承担设备总价百分之十（10%）的违约金，并承担甲方因此所受的直接经济损失。该违约金及赔偿，乙方应在一个月内予以赔偿。第十二条合同变更12.1甲乙双方的任何一方对合同内容提出修改，均应以书面形式通知对方，并签订由双方确定的合同修改书或补充 。12.2除非甲方对设备的型号、规格和涉及价格因素的技术参数和图纸提出修改，甲乙双方均不得对本合同的成交价格提出修改要求。12.3如本工程需增加或更换（不在质量三包期内）设备，则设备及安装费用按设备清单中的相应单价结算，其余费用（运费、验收费）等一概不予结算。第十三条合同争议的解决办法本合同在履行过程中发生的争议，由双方当事人协商，协商不成的，则依法向****市人民法院提起诉讼，不论变更与否，均以此条款为准。第十四条合同效力14.1本合同中如有未尽事宜，须经合同双方共同协商，作出补充规定，补充规定与本合同具有同等法律效力。本合同的组成部分包括：设备价格清单，与本合同具有同等法律效力，各组成部分的规定和本合同条款如有冲突，以本合同条款为准；如本合同条款有未尽事宜，则参照组成部分的规定。14.2本合同自双方盖章，签字之日起生效。14.3本合同一式肆份，甲方叁份，乙方壹份，具有同等法律效力。第十五条未尽事宜对于密集型母线槽的材料要求以及性能指标要求：15.1外壳材质：为保证母线槽的强度和刚度，母线槽系统外壳应采用不低于3mm冷轧镀锌钢板或优质铝镁合金外壳；具备一定抗机械冲击力，不接受普通铝合金外壳。15.2外壳防腐蚀：母线外壳表面应作静电粉末喷涂处理，以达到良好的防腐蚀效果。15.3导体：母线槽的导体采用符合GB5585国家标准的电工用纯铜排，母线槽导体材料要求采用高导电率的铜排，且纯度应≧99.95%（均须出具进货有效证明原件），导体表面需采用可靠、环保的防腐处理工艺，以延长导体的使用寿命。15.4导体完整性：为保证母线槽的载流能力及结构强度，母线直身段导体全长应保持密集不可分割的完整性，（包括插接单元），有效较低电阻、电抗，不得有中间冲孔、末端截面收缩等不良设计。15.5绝缘材料；绝缘材料应是国内外知名厂商生产的产品；要求采用B级以上绝缘（130℃）的聚脂薄膜整块包裹；应提供绝缘材料的第三方检测报告。15.6母线耐压：封闭式母线能承受1min内(3000V50Hz)交流电，而无击穿和闪络现象（提供试验报告）。15.7连接头设计：母线连接头要求为独立可移动式，便于母线的安装及拆卸；连接头螺栓应带有自动力矩控制功能，额定压接力矩不应小于70N.M保证接头有良好的接触：在压接力矩达到规定值后，应当有醒目的指示，方便检查；连接头应设计先进，日后可免维护；防护等级IP54及以上的母线，接头处应采用全封闭结构，接头螺栓不能外露，保证其防护等级与母线直线段一致。15.8连接头接触：连接头应采用双面措接技术，连接头处导体总截面积应适当增大30％以上，以增强该部位的载流能力。15.9插接口设计：母线槽插接口处导体需镀银，保证与插接箱连接的低阻抗性；（不接受扩张母排）导致温升增高。15.10插接箱连锁保护：所有母线插接箱均应配备内部安全连锁：在通电情况下，防止插接箱门被打开；在
