RecordsofRevisionandtheApproval日期DATE修改内容AMENDMENT主管机关ADMINISTRATION、尸■、亠前言INTRODUCTION于2013年1月1日生效的经修订的MARPOL附则V,除非附则明确许可，禁止将任何种类的垃圾排放入海。TherevisedMARPOLAnnexVwithanentryintoforcedateof1January2013,prohibitsthedischargeofalltypesofgarbageintotheseaunlessexplicitlypermittedundertheAnnex.MARPOL附贝卩V规定，除了MARPOL附贝卩V第3、4、5禾口6条的特殊许可外，禁止排放一切垃圾。MARPOL附则V推翻了历史上按垃圾性质来认定哪些垃圾可以排放入海的规定方式以及距岸距离的定义。第7条规定了应急和非正常情况下的例外情况。 上排放限于食品废弃物、标明的货物残余、动物尸体以及洗涤水中包含的标明的对环境无害的清洁剂、添加剂和货物残余。建议船舶使用港口接收设施作为排放所有垃圾的首选方式。UndertherevisedMARPOLAnnexV,dischargeofallgarbageisnowprohibited,exceptasspecificallypermittedinregulations3,4,5and6ofMARPOLAnnexV.MARPOLAnnexVreversesthehistoricalpresumptionthatgarbagemaybedischargedintotheseabasedonthenatureofthegarbageanddefineddistancesfromshore.Regulation7provideslimitedexceptionstotheseregulationsinemergencyandnon-routinesituations.Generally,dischargeisrestrictedtofoodwastes,identifiedcargoresidues,animalcarcasses,andidentifiedcleaningagentsandadditivesandcargoresiduesentrainedinwashwaterwhicharenotharmfultothemarineenvironment.Itisrecommendedthatshipsuseportreceptionfacilitiesastheprimarymeansofdischargeforallgarbage.100总吨及以上的船舶和核准载运15名或以上人员的船舶以及固定或浮动平台,均应备有1份垃圾管理计划。everyshipof100grosstonnageandabove,andeveryshipcertifiedtocarry15ormorepersons,andfixedorfloatingplatformsshallcarryagarbagemanagementplan;本计划的主要目标是帮助船东、船舶经营人、船员遵循载于附则V中的要求和有关国内法规。Themainobjectivesofthisplanaretoassistshipowners,shipoperators,ships'crews,incomplyingwithrequirementssetforthinAnnexVandrelevantdomesticlaws.本计划根据国际海事组织制定的《经1978年议定书修订的1973年国际防止船舶造成污染公约》（以下简称MARPOL73/78公约）经修订的附则V第10条的要求和我国有关规定编写的。ThisplaniswritteninaccordancewiththerequirementsRegulation10ofRevisedMARPOLAnnexVoftheInternationalConventionforthePreventionofPollutionfromShip's,1973,asmodifiedbytheProtocolof1978relatingthereto(MARPOL73/78)bytheInternationalMaritimeOrganizationandthedomesticlawsrequirements.本计划包括了国际海事组织制定的“2012年垃圾管理计划编制指南”所要求的全部资料和操作程序。并参考了其它利于船上垃圾处理的技术指南如：ISO21070“船上垃圾管理和处理 、教育工作；trainingandeducationforthecrew;.船舶发生垃圾污染事故时，组织船员进行应急处理并及时报告主管机关。Musterthecrewtotakeemergencyactionwhengarbagepollutionhappens.具体实施负责人职责Thedutiesofthedesignatedperson本船《垃圾管理计划》具体实施负责人是本船大副，其主要职责是：Thechiefofficeristhedesignatedpersonoftheimplementationoftheplan,hisdutieswillinclude:.检查“垃圾公告牌”是否符合要求；ensuringplacardsaredisplayedinaccordancewiththeRegulationsspecifiedinMARPOL73/78.教育船员遵守船上垃圾管理计划；monitoringthecrewtocomplywiththePlan.根据设备功能进行垃圾焚烧；incinerationofwastesinaccordancewiththeequipmentmanufacturer'sinstructions;.联系垃圾的岸上回收业务；liaisontheshoreauthoritiesforportreceptionfacilities;.按照规则的要求在记录簿上填写并签字。Signingthegarbagerecordbookasrequiredbytheregulations.垃圾收集处理人员职责Dutiesofthepersonsinchargeofcollecting,handlinggarbage船上的大厨、水手长、机工负责垃圾的收集、处理工作。Ship'cshiefcook,bosunandmotormanisresponsibleforcollectingandhandlinggarbage.垃圾收集处理人员的职责包括：Theirdutieswillinclude：.收集处理船上垃圾；collecting,handlingdailygarbage;.垃圾分类separatinggarbage;.保持垃圾储存点的卫生。Cleaningtheplaceofstoringgarbage.垃圾处理设备管理人员职责Dutiesofpersonswhooperatethegarbagehandlingequipment.操作设备Operatingtheequipment.负责所管设备的维修保养，使其处于良好状态。Maintenancetheequipmentandmakethemingoodcondition.全体船员职责Dutiesofthecrewonboard..严格遵守《垃圾管理计划》的要求；observetheplanstrictly;.认真参加《垃圾管理计划》的培训和演习；takepartinthetraininganddrilling.船舶发生垃圾污染事故时，按大副指令参加应急处理工作Takeemergencyactionswhengarbagepollutionhappens.第二章法定要求ChapterIIREGULATORYREQUIREMENTASMARPOL73/78附则V第10条Regulation10ofAnnexVofMARPOL73/78readsasfollows:第10条Regulation10公告标牌、垃圾管理计划和垃圾记录保存Placards.Garbagemanagementplansandgarbagerecording-keeping(1)(a)总长度为12m或以上的船舶和固定或浮动平台均应张贴告示以使船员和乘客知晓本附则第3、4、5和6条中适用的排放要求。Everyshipof12mormoreinlengthoverallandfixedorfloatingplatformsshalldisplayplacardswhichnotifythecrewandpassengersofthedischargerequirementsofregulations3,4,5and6ofthisAnnex,asapplicable.告示应以船员的工作语言书写，对航行于其他本公约缔约国管辖权范围内的港口或近海装卸站的船舶，告示还应以英文、法文或西班牙文书写。Theplacardsshallbewrittenintheworkinglanguageoftheship'screwand,forshipsengagedinvoyagestoportsoroffshoreterminalsunderthejurisdictionofotherPartiestotheConvention,shallalsobeinEnglish,FrenchorSpanish.(2)所有100总吨及以上的船舶和核准载运15名或以上人员的船舶以及固定或浮动平台，均应备有一份船员必须遵守的垃圾管理计划。该计划应就减少、收集、储藏、加工和处理垃圾以及船上设备使用等提供书面程序，还应指定负责执行该计划的人员。该计划应基于本组织制定的指南，并用船员的工作语言书写。Everyshipof100grosstonnageandabove,andeveryshipwhichiscertifiedtocarry15ormorepersons,andfixedorfloatingplatformsshallcarryagarbagemanagementplanwhichthecrewshallfollow.Thisplanshallprovidewrittenproceduresforminimizing,collecting,storing,processinganddisposingofgarbage,includingtheuseoftheequipmentonboard.Itshallalsodesignatethepersonorpersonsinchargeofcarryingouttheplan.SuchaplanshallbebasedontheguidelinesdevelopedbytheOrganization2andwrittenintheworkinglanguageofthecrew.在公约其他缔约国管辖下的港口或近海装卸站之间从事运输的所有400总吨及以上的船舶和经核定可载运15人或以上的船舶以及用于勘探和开发海床的固定或浮动平台都应配备《垃圾记录簿》。该《垃圾记录簿》，无论是否作为正式航海日志的一部分，还是其他形式,都应采用本附则附录中规定的格式：Everyshipof400tonsgrosstonnageandaboveandeveryshipwhichiscertifiedtocarry15personsormoreengagedinvoyagestoportsoroffshoreterminalsunderthejurisdictionofanotherPartiestotheConventionandeveryfixedandfloatingplatformengagedinexplorationandexploitationofthesea-bed,shallbeprovidedwithagarbagerecordbook.Thegarbagerecordbook,whetherasapartoftheship'sofficiallogbookorotherwise,shallbeintheformspecifiedintheAppendixtothisAnnex.(a)每次排放入海或至接收设备或完成的焚烧作业都应立即记录在《垃圾记录簿》中，并在焚烧或排放的当天由负责的高级船员签字。《垃圾记录簿》每记完一页都应由船长签字。《垃圾记录簿》的每项记载应至少用英文、法文或西班牙文书写。如果这些记载也使用该船船旗国的官方语言书写，在发生争执或有不同意见时，以船旗国的官方语言的记载为准。Eachdischargeintotheseaortoareceptionfacility,oracompletedincineration,shallbepromptlyrecordedinthegarbagerecordbookandsignedforonthedateoftheincinerationordischargebytheofficerincharge.Eachcompletedpagepfthegarbagerecordbookshallbesignedbythemasteroftheship.TheentriesintheGarbageRecordBookshallbeatleastinEnglish,FrenchorSpanish.WheretheentriesarealsomadeinanofficiallanguageoftheStatewhoseflagtheshipisentitledtofly,theentriesinthatlanguageshallprevailincaseofadisputeordiscrepancy.每次排放或焚烧的记录都应写明日期与时间、船舶位置、垃圾种类和焚烧或排放垃圾的估计数量；Theentryforeachincinerationordischargeshallincludedateandtime,positionoftheship,categoryofthegarbageandtheestimatedamountincineratedordischarged;《垃圾记录簿》应保存在船上或固定或浮动平台上的合适的位置以使在合理的时间内可随时取来接受检查。《垃圾记录簿》应自最后一次记录日期起保存2年；Thegarbagerecordbookshallbekeptonboardtheshiporthefixedorfloatingplatform,andinsuchaplaceastobeavailableforinspectioninareasonabletime.Thisdocumentshallbepreservedforaperiodoftwoyearsfromthedateofthelastentryismadeontherecord;如发生本附则第7条所指的任何排放或意外落失，垃圾记录簿上应予以记录，或对任何小于400总吨的船舶，应在该船的正式航海日志中记录该排放或落失的地点、情况和原因、排放或落失的物品细目、以及为防止或尽量减少这种排放或意外落失业已采取的合理预防 。Intheeventofanydischargeoraccidentallossreferredtoinregulation7ofthisAnnexanentryshallbemadeintheGarbageRecordBook,orinthecaseofanyshipoflessthan400grosstonnage,anentryshallbemadeintheship'sofficiallog-book,ofthelocation,circumstancesof,andthereasonsforthedischargeorloss,detailsoftheitemsdischargedorlost,andthereasonableprecautionstakentopreventorminimizesuchdischargeoraccidentalloss.主管机关可以对下述船舶免除《垃圾记录簿》要求TheAdministrationmaywaivetherequirementsforgarbagerecordbooksfor:(i)核准载运15名或以上人员，航行持续时间为1h或以下的船舶；或Anyshipengagedonvoyagesofone(1)hourorlessindurationwhichiscertifiedtocarry15personsormore;or(ii)从事海床勘探与开发的固定或浮动的平台。fixedorfloatingplatformswhileengagedinexplorationandexploitationofthesea-bed.本公约缔约国政府的主管机关，可检查停靠其港口或近海装卸站的适用本规定的任何船舶的《垃圾记录簿》或船舶的正式航海日志，并可将记录簿或日志中的任何记录制成副本并要求船长证明该副本是该项记录的真实副本。这种经船长证明为船上《垃圾记录簿》或船舶的正式航海日志中某项记录的真实的副本在任何法律诉讼中应作为该项记录中所述事实的证据。主管机关根据本项规定对《垃圾记录簿》或船舶的正式航海日志的检查和制作确证无误的副本应尽速进行，并不应对船舶造成不当的延误。ThecompetentauthorityoftheGovernmentofaPartytotheConventionmayinspectthegarbagerecordbookorship'sofficiallog-bookonboardanyshiptowhichthisregulationapplieswhiletheshipisinitsportsoroffshoreterminalsandmaymakeacopyofanyentryinthosebooks,andmayrequirethemasteroftheshiptocertifythatthecopyisatruecopyofsuchanentry.Anycopysomade,whichhasbeencertifiedbythemasteroftheshipasatruecopyofanentryintheship'gsarbagerecordbookorship'sofficiallog-book,shallbeadmissibleinanyjudicialproceedingsasevidenceofthefactsstatedintheentry.Theinspectionofagarbagerecordbookorship'sofficiallog-bookandthetakingofacertifiedcopybythecompetentauthorityunderthisparagraphshallbeperformedasexpeditiouslyaspossiblewithoutcausingtheshiptobeundulydelayed.如第7.1.3和第7.1.3条中所述的渔具的意外落失或排放会对海洋环境或航行造成严重威胁，应向船舶的船旗国报告，如果落失或排放发生在某一沿海国家管辖权范围内的水域，也应向该沿海国家报告。Theaccidentallossordischargeoffishinggearasprovidedforinregulationsand7.1.3whichposesasignificantthreattothemarineenvironmentornavigationshallbereportedtotheStatewhoseflagtheshipisentitledtofly,and,wherethelossordischargeoccurswithinwaterssubjecttothejurisdictionofacoastalState,alsotothatcoastalState.第三章船舶垃圾及防污染ChapterIIIPREVENTIONOFPOLLUTIONFROMGARBAGE为了确保经济效益和环境保护，船舶垃圾管理人员应合理调节以下工作Toachievecost-effectiveandenvironmentallysoundresults,manygarbagemanagementplannersuseacombinationofthreecomplementarytechniquestomanagegarbage:减少垃圾产生的来源reductionatsource垃圾再利用或再循环reusingorrecycling船上垃圾加工(处理)onboardprocessing(treatment)1.4允许排放时按限制条件排放入海；和dischargeintotheseainthoselimitedsituationswhereitispermitted;and1.5排入港口接收设施dischargetoaportreceptionfacility.当船舶提出供应备件/伙食时，航运公司应在早期阶段鼓励供应商去除、减少包装，限制产生船舶垃圾。Whenrequisitioningstoresandprovisions,shippingcompaniesshouldencouragetheirsupplierstoremove,reduce,allpackaging,atanearlystage,tolimitthegenerationofgarbageonboardships.船上的垃圾种类，部分根据MARPOL73/78附则V规定进行分类。但有些可根据地区、国家或地方，另分类，如：生活、航行、货物、食品、检修方面所产生的垃圾。船舶的垃圾按MARPOL73/78附则V第10条的规定，下方第4.1段将垃圾分成9大类。Theship'gsarbageismadeupofdistinctcomponents,someofwhichareregulatedinMARPO-73/78,whilstothersmayberegulatedlocally,nationallyorregionally,e.g.,domestic,operational,cargo-associated,foodandmaintenancewastes.Thegarbageistobegroupedinto9categoriesspecifiedbelowinparagraph4.1forthepurposeoftherequirementsofRegulation10ofAnnex..V4垃圾记录簿及记录Garbagerecordbookandgarbagerecord-keeping4.1按照附则V，《垃圾记录簿》不论是船舶的正式航海日志的一部分，还是其他形式，均应和本附则的附录格式相同：InaccordancewiththeAppendixtoAnnexV,thegarbagerecordbook,whetherasapartofship'sofficiallogbookorotherwise,shallebefoirnmthspecifiedintheappendixtothisAnnex:FORMOFGARBAGERECORDBOOK垃圾记录簿格式Nameofship船名：Distinctivenumberorletters船舶编号或呼号:IMONo编号.：Period时间:From自：To至:Descriptionofthegarbage垃圾种类GarbageistobegroupedintocategoriesforthepurposesoftheGarbageRecordBook(orship'sofficiallog-book)asfollows:就本记录簿(或船舶的正式航海日志)而言，垃圾分类如下：APlastics塑料BFoodwastes食品废弃物CDomesticWastes生活废弃物DCookingOil食用油EIncineratorashes焚烧炉灰渣FOperationalwastes作业废弃物GCargoresidues货物残余HAnimalCarcass(es)动物尸体IFishingGear渔具垃圾排放记录Ship'sname船名）:DistinctiveNo.,orletters（船舶编号或呼号）:IMONo.（IMO编号）:Date/Time日期/时间PositionoftheShip/Remarks（e.g.,accidentalloss）船位/备注（如:意外落失）Category种类EstimatedAmountDischargedorIncinerated排放或焚烧的估算量ToSea至海ToReceptionFacility至接收设备Incineration焚烧Certification/Signature证明/签字Master'ssignature船长签字：Date日期：4.2.发生下列情况时，应在垃圾记录簿上填写：EntriesintheGarbageRecordBookshallbemadeoneachofthefollowingoccasions:4.2.1.当垃圾排放至岸上接收设备5或排放至其他船舶时：Whengarbageisdischargedtoareceptionfacilityashoreortootherships:.1排放的日期和时间；Dateandtimeofdischarge.2港口或设施或船舶的名称；Portorfacility,ornameofship.3所排放垃圾的种类；Categoriesofgarbagedischarged.4每种排放垃圾的估算量（m3）；Estimatedamountdischargedforeachcategoryincubicmetres.5负责作业的主管高级船员签字。Signatureofofficerinchargeoftheoperation.当焚烧垃圾时：Whengarbageisincinerated:.1焚烧的日期和开始及结束时间；Dateandtimeofstartandstopofincineration.2焚烧开始和结束时的船位（经度和纬度）；Positionoftheship（latitudeandlongitude）atthestartandstopofincineration.3焚烧的垃圾的种类；Categoriesofgarbageincinerated.4焚烧的垃圾的估算量（m3）；Estimatedamountincineratedincubicmetres.5负责作业的主管高级船员签字。Signatureoftheofficerinchargeoftheoperation.当垃圾按MARPOL附则V第4、5或6条规定排放入海时：Whengarbageisdischargedintotheseainaccordancewithregulations4,5or6ofAnnexV
