UNITYTERMSOFSERVICELastupdated:June28,2016UnityTechnologiesApS(“Unity”,“our”or“we”)providessoftwaretodevelopgamesandinteractivecontent(the“Software”),relatedservices(likeUnityAnalytics(“DeveloperServices”)),andvariousUnitycommunities(likeUnityAnswersandandtheMadewithUnityPlatform(“Communities”)),providedthroughorinconnectionwithourwebsite,accessibleatunity3d.com(the“Site”).ExcepttotheextentyouandUnityhaveexecutedaseparateagreementgoverningyouruseoftheSoftwareand/orDeveloperServices,thesetermsandconditionsexclusivelygovernyouraccesstoanduseoftheSoftware,DeveloperServices,CommunitiesandSite(collectively,the“Services”),andconstituteabindinglegalagreementbetweenyouandUnity(the“Terms”).TheseTermsandanyAdditionalTermsare,collectively,the“Agreement.”IfyouacceptoragreetotheAgreementonbehalfofacompany,organizationorotherlegalentity(a“LegalEntity”),yourepresentandwarrantthatyouhavetheauthoritytobindthatLegalEntitytotheAgreementand,insuchevent,“you”and“your”willreferandapplytothatcompanyorotherlegalentity.YOUACKNOWLEDGEANDAGREETHAT,BYACCESSING,PURCHASINGORUSINGTHESERVICES,YOUAREINDICATINGTHATYOUHAVEREAD,UNDERSTANDANDAGREETOBEBOUNDBYTHEAGREEMENTWHETHERORNOTYOUHAVECREATEDAUNITYACCOUNT,SUBSCRIBEDTOTHEUNITYNEWSLETTEROROTHERWISEREGISTEREDWITHTHESITE.IFYOUDONOTAGREETOTHESETERMSANDALLAPPLICABLEADDITIONALTERMS,THENYOUHAVENORIGHTTOACCESSORUSEANYOFTHESERVICES.1.YOURUSEOFTHESERVICES1.1ELIGIBILITY.TheServicesareintendedsolelyforpersonswhoare13orolder.ExceptasexpresslyprovidedotherwiseontheSite,theServicesareintendedforpersons13andolderprovided,however,youmustbeatleast18tomakepurchasesorsubmitcontenttoUnity.Ifyouareundertheageof18orwhateveristheageoflegalmajoritywhereyouaccesstheServices,youmaypurchaseaccesstotheServicesonlywiththeinvolvementofyourlegalguardian,andyourepresentandwarrantthatyourlegalguardianhasread,understoodandagreedtothisAgreement.1.2PRIVACY.Yourprivacyisimportanttous.Unity’sPrivacyPolicydisclosestheinformationwecollectandhowweuseit.ByusinganyofthetheServices,youagreetothetermsofthePrivacyPolicy,sopleasereviewthePrivacyPolicycarefully.YouaffirmthatyouhavereadandacceptthePrivacyPolicyanditsterms.1.3ADDITIONALTERMS.TheSoftware,DeveloperServicesandSite/Communitiesaresubjecttoadditionaltermsasshownbelow(“AdditionalTerms”).SiteandCommunitiesSiteandCommunitiesAdditionalTermsSoftwareUnityPersonal,UnityPlusandUnityProAdditionalTermsUnityCertificationMaterialsAdditionalTermsDeveloperServicesUnityAnalyticsandIAPAdditionalTermsUnityCloudBuildAdditionalTermsUnityCollaborateAdditionalTermsUnityMultiplayerAdditionalTermsIfthereisanyconflictbetweentheseTermsandtheAdditionalTerms,theAdditionalTermsgoverninrelationtotherelevantSoftware,DeveloperServiceorSite/Communities.UnityAdsisoperatedbyUnityTechnologiesFinlandOyandhasitsowntermsandconditionsforthepublishersandadvertisersutilizingitsservices.TheUnityAssetStorehasseparatetermsandconditionsforuseoftheAssetStoreandAssetStoreProviders.1.4MODIFICATION.Unityreservestheright,atitssolediscretion,tomodify,discontinueorterminatetheServices.UnitymayalsomodifytheAgreementatanytimeandwithoutpriornotice.IfwemodifytheAgreement,wewillpostthemodificationontheSiteorotherwiseprovideyouwithnoticeofthemodification.Wewillalsoupdatethe“Lastupdated”dateatthetopoftheseTerms.BycontinuingtoaccessorusetheServicesafterwehaveprovidedyouwithnoticeofamodification,youindicatethatyouagreetobeboundbythemodifiedTerms.IfthemodifiedTermsarenotacceptabletoyou,youronlyrecourseistoceaseusingtheServices.2.YOURUNITYACCOUNTInordertousemostServices,youmustregisterfora“UnityAccount”.TocreateaUnityAccount,youwillberequiredtoprovidecertaininformationandyouwillestablishausernameandapassword.Youagreetoprovideaccurate,currentandcompleteinformationduringtheregistrationprocessandtoupdatesuchinformationtokeepitaccurate,currentandcomplete.Unityreservestherighttosuspendorterminateyouraccountifanyinformationprovidedduringtheregistrationprocessorthereafterprovestobeinaccurate,notcurrentorincomplete.Youareresponsibleforsafeguardingyourpassword.Youagreenottodiscloseyourpasswordtoanythirdpartyandtotakesoleresponsibilityforanyactivitiesoractionsunderyouraccount,whetherornotyouhaveauthorizedsuchactivitiesoractions.YouwillimmediatelynotifyUnityofanyunauthorizeduseofyouraccount.YoumaycancelyourUnityAccountatanytimebysendinganemailtosupport@unity3d.com.CancelingyourUnityAccountdoesnotrelieveyouoftheobligationtopayanyandallremainingamountsowingforyourexistingSoftwareorDeveloperServicesubscriptions3.YOURRESPONSIBILITIESYourepresentandwarrantthat:(a)youhavethelegalcapacitytoagreetotheAgreement;(b)youarenotlocatedinacountryembargoedbytheUnitedStatesandthatyouarenotontheU.S.TreasuryDepartment'slistofSpeciallyDesignatedNationals;and(c)youwillcomplywithallapplicablelawsandregulationsinconnectionwithyouruseoftheServices(includingbutnotlimitedtoapplicableFederalTradeCommissionrulesandCOPPA),andinaccordancewiththetermsandconditionsspecifiedintheAgreement.4.INTELLECTUALPROPERTYRIGHTS4.1UNITY’SOWNERSHIP.TheSite,Software,DeveloperServices,CommunitiesandWebsiteContent(asthattermisdefinedintheSiteandCommunitiesAdditionalTerms)areprotectedbycopyright,trademark,andotherlawsoftheUnitedStatesandforeigncountries.ExceptasexpresslyprovidedintheAgreement,Unityanditslicensorsexclusivelyownallright,titleandinterestinandtotheServices,includingallassociatedintellectualpropertyrights.Youwillnotremove,alterorobscureanycopyright,trademark,servicemarkorotherproprietaryrightsnoticesincorporatedinoraccompanyingtheServices.4.2YOURCONTENT.AsbetweenyouandUnity,youownallright,titleandinterest(including,allintellectualpropertyrights)inandtothecontentyoucreateusingtheSoftware,DeveloperServicesand/oranycontentyouposttotheSiteorintheCommunities(collectively,“YourContent”)(otherthananycomponentsoftheSoftwarecontainedthereinorusedinconnectiontherewith).4.3COPYRIGHTPOLICY.Unityrespectscopyrightlawandexpectsitsuserstodothesame.Unityhasadoptedandimplementedapolicythatprovidesfortheterminationinappropriatecircumstancesofregisteredusersorotheraccountholderswhorepeatedlyinfringeorarebelievedtoberepeatedlyinfringingtherightsofcopyrightholders.PleaseseeUnity’sCopyrightPolicyforfurtherinformation.4.4PROPRIETARYRIGHTSNOTICES.Alltrademarks,servicemarks,logos,tradenamesandanyotherproprietarydesignationsofUnityusedhereinaretrademarksorregisteredtrademarksofUnity.Anyothertrademarks,servicemarks,logos,tradenamesandanyotherproprietarydesignationsarethetrademarksorregisteredtrademarksoftheirrespectiveparties.5.PAYMENTS5.1FEES.FeesforcertainServicesaresetforthontheSiteorviatheservicepanelintheSoftware(the“ServicePanel”).Unitymayincrease,modifyoraddnewfeesandchargesforanyoftheServicesfromtimetotimebypostingsuchchangestotheSiteorwithintheServicesPanel.Unitywillprovideyouwithatleast30days’noticeofanychangesaffectingexistingSoftwareand/orDeveloperServicesyouhavealreadystartedusing,andyourcontinueduseofsuchSoftwareand/orDeveloperServiceaftertheeffectivedateofanysuchchangemeansthatyouacceptandagreetosuchchanges,asapplicable.YouagreetopayallamountsduefortheServicesassetforthintheonlinecart,quoteorinvoiceandinaccordancewithUnity'spaymenttermsand,ifapplicable,thoseofanypaymentprocessor.AllfeespayableundertheAgreementarenetamountsandpayableinfull,withoutdeductionfortaxesordutiesofanykind.Youwillberesponsiblefor,andagreetopromptlypay,alltaxesordutiesofanykind(includingbutnotlimitedtosales,useandwithholdingtaxes)associatedwithanypurchaseoryourreceiptoruseoftheSoftwareand/orDeveloperServices,exceptfortaxesbasedonUnity’snetincome.IntheeventthatUnityisrequiredtocollectanytaxforwhichyouareresponsible,youwillpaysuchtaxdirectlytoUnityoritspaymentprocessor.Ifyoupayanywithholdingtaxesthatarerequiredtobepaidunderapplicablelaw,youwillpromptlyfurnishUnitywithwrittendocumentationofallsuchtaxpayments,includingreceipts.Unityreservestherighttocollectanyapplicablesales,useorvalueaddedtax.Allsalesarefinalandthereshallbenorefundsexceptasrequiredbylaw.Further,Unitywillnotallowchangestoyourpurchaseafteryoucompleteit.UnitymaydisableallcopiesoftheSoftwareand/oryouraccesstoanyDeveloperServicesyouhavelicensedorsubscribedtointheeventyoufailtomakeallpaymentswhendue.Youacknowledgeandagreethat,inthecaseofcertainDeveloperServices,anyestimatesoffeesandchargesprovidedtoyoubyUnity(whetherbasedonassumeddataconsumptionorotherwise)aresolelyestimatesbasedonassumptionsandthatyouarefullyresponsiblefortheactualfeesandchargesthataccrue.5.2BILLING.IfyoupurchaseServices,youwillbeaskedtoprovidecustomarybillinginformationsuchasname,companyname,billingaddress,creditcardinformationandVATnumber(forEUresidents)eithertoUnityoritsthirdpartypaymentprocessor.VATnumberscannotbeaddedorchangedafterthepurchaseiscompleted.WhenyouprovidebillinginformationtoUnityoritsthirdpartypaymentprocessor,you:(i)representandwarrantthatyouaretheauthorizeduserofthecard,PIN,keyoraccountassociatedwithsuchbillinginformation;(ii)agreetopayUnityforallpurchases(includingallapplicabletaxes)madeviatheSiteorServicesPanel;and(iii)therebyauthorizeUnityoritsthirdpartypaymentprocessortochargeyourcreditcardorotherwiseprocessyourpaymentforanypurchase,subscriptionorotherfeesincurredbyyou.IfyouaredirectedtoUnity’sthirdpartypaymentprocessor,youmaybesubjecttotermsandconditionsgoverninguseofthatthirdparty’sserviceandthatthirdparty’sprivacypolicy.Pleasereviewsuchthirdparty’stermsandconditionsandprivacypolicybeforeusingsuchservices.5.3SUBSCRIPTIONTERMS.IfyoupurchaseasubscriptiontousetheServices,youalsoagreetothesubscriptiontermssetforthontheSite.Anysubscriptionsyoupurchasewillremainineffectfortheinitialsubscriptionperiod,andthereafterwillautomaticallyrenewonamonth-to-monthbasisatthethen-currentlistprice,unlessyourenewthesubscriptionforanewsubscriptiontermorterminateandcancelitasdescribedontheSite.6.COMPLIANCEToensurecompliancewiththeAgreement,youagreethatwithinten(10)daysfromthedateofUnityoritsauthorizedrepresentative’srequest,youshallprovideallpertinentrecordsandinformationrequestedinordertoverifythatyourinstallationanduseofanyandallServicesisincompliancewiththeAgreementalongwithasignedverificationthatallsuchinformationiscompleteandcorrect.Furthermore,ifyouareaLegalEntity,UnityoritsauthorizedrepresentativesmayuponreasonablepriornoticeaccessandinspectyourfacilitiesandcomputersystemstoreviewandverifyyourcompliancewiththeAgreement.Anysuchinspectionshallbeconductedduringregularbusinesshoursatyourfacilitiesorelectronicallyviaremoteaccess.IntheeventyouhaveimpermissiblyusedUnityPersonal(orotherproducts)orhavenotpaidtheapplicablefeesforallSoftwareand/orDeveloperServicesyouhavedeployedorused,youagreetoimmediatelypayforsuchSoftwareandDeveloperServices,aswellasthereasonableinspectioncosts,uponUnity’sdemand.7.TERMINATIONANDACCOUNTCANCELLATIONUnitywillhavetherightinitssolediscretion,andwithoutpriornoticetoyou,tosuspendordisableyourUnityAccountorterminatetheAgreementand/oryourrightorabilitytoaccessoruseanyoftheServicesif:(a)youbreachthisAgreement;(b)youruseoftheServicesposesasecurityriskto,orotherwiseadverselyimpacts,theServicesoranythirdparty;(c)youruseoftheServicessubjectsUnity,ouraffiliatesoranythirdpartytoliability;(d)youruseoftheServicesmaybefraudulent;(e)youhaveceasedtooperateintheordinarycourse,madeanassignmentforthebenefitofcreditorsorsimilardispositionofyourassets,orbecomethesubjectofanybankruptcy,reorganization,liquidation,dissolutionorsimilarproceeding.Intheeventofanysuspension,disablementortermination,youacknowledgethat:(i)UnitywillhavenofurtherobligationtoprovidetheServicestoyou;(ii)allrightsgrantedtoyouundertheAgreementwillimmediatelycease;(iii)youmaynolongeraccessanyofYourContentthatwaspreviouslysubmittedviaanyoftheServicesorthatwasrelatedtoyourUnityAccount,andUnitywillhavenoobligationtomaintainorforwardyouYourContent;and(iv)youwillremainliableforallfeesandchargesforallServicesordered.IfUnitysuspends,disablesorterminatesduetoyourbreach,youwillalsoremainliableforanyremainingamountsowingfortheentiretermofyoursubscriptions.Anysuspension,disablementorterminationwillnotaffectyourobligationstoUnity(including,withoutlimitation,proprietaryrightsandownership,indemnificationandlimitationofliability),whichbytheirsenseandcontextareintendedtosurvivesuchsuspension,disablementortermination.8.DISCLAIMERTHESERVICESAREALLPROVIDEDBYUNITYONAN“ASIS”AND“ASAVAILABLE”BASIS,WITHOUTANYREPRESENTATIONS,WARRANTIES,COVENANTSORCONDITIONSOFANYKIND.UNITYANDITSLICENSORSDONOTWARRANTORREPRESENTTHATTHESERVICES,ORANYPARTTHEREOF,WILLOPERATEUNINTERRUPTEDORERROR-FREE.UNITYANDITSLICENSORSDISCLAIMALLWARRANTIESANDREPRESENTATIONS(EXPRESSORIMPLIED,ORALORWRITTEN),WHETHERALLEGEDTOARISEBYOPERATIONOFLAW,BYREASONOFCUSTOMORUSAGEINTHETRADE,BYCOURSEOFDEALINGOROTHERWISE,INCLUDINGANYANDALL:(I)WARRANTIESOFMERCHANTABILITY;(II)WARRANTIESOFFITNESSORSUITABILITYFORANYPURPOSE(WHETHERORNOTUNITYKNOWS,HASREASONTOKNOW,HASBEENADVISEDORISOTHERWISEAWAREOFANYSUCHPURPOSE);AND(III)WARRANTIESOFNONINFRINGEMENTORCONDITIONOFTITLE.NOADVICEORINFORMATION,WHETHERORALORWRITTEN,OBTAINEDFROMUNITYORELSEWHEREWILLCREATEANYWARRANTYORCONDITIONNOTEXPRESSLYSTATEDINTHEAGREEMENT.YoushallbesolelyresponsiblefortheaccuracyandqualityofYourContent,andyouunderstandthatyoumustevaluateandbearallrisksassociatedwithyouruseoftheServices,oryourrelianceontheaccuracy,completeness,orusefulnessoftheServices.9.INDEMNITYTothemaximumextentpermittedbylaw,youagreetodefend,indemnify,andholdUnity,itsofficers,directors,employeesandagents,harmlessfromandagainstanyandallclaims,actions,suitsorproceedings,aswellasanyandalllosses,liabilities,damages,costsandexpenses,including,withoutlimitation,reasonablelegalandaccountingfees,arisingoutoforinanywayconnectedwith:(i)youraccesstooruseofanyoftheServices;(ii)YourContent;or(iii)yourviolationoftheAgreement.10.LIMITATIONOFLIABILITYUNITYANDITSLICENSORS’TOTALAGGREGATELIABILITYTOYOUFROMALLCAUSESOFACTIONANDUNDERALLTHEORIESOFLIABILITYRELATEDTOTHESERVICESWILLBELIMITEDTOTHEGREATEROF:(A)THEAMOUNTSPAIDBYYOUINTHEMOSTRECENTTHREE(3)MONTHSFORUSEOFTHESERVICES;OR(B)ONEHUNDREDU.S.DOLLARS(US$100).INNOEVENTWILLUNITY,ITSLICENSORSORANYOTHERPARTYINVOLVEDINCREATING,PRODUCINGORDELIVERINGTHESERVICESBELIABLETOYOUFORANYSPECIAL,INCIDENTAL,EXEMPLARY,PUNITIVEORCONSEQUENTIALDAMAGES(INCLUDINGLOSSOFDATA,BUSINESS,PROFITS,GOODWILL,SERVICEINTERRUPTION,COMPUTERDAMAGE,SYSTEMFAILUREORABILITYTOEXECUTE)ORFORTHECOSTOFPROCURINGSUBSTITUTEPRODUCTSORSERVICESARISINGOUTOFORINCONNECTIONWITHTHEAGREEMENTORTHEEXECUTIONORPERFORMANCEOFTHESOFTWAREORDEVELOPERSERVICES,ORFROMTHEUSEORINABILITYTOUSETHESITE,COMMUNITIESORWEBSITECONTENT,ORFROMANYCOMMUNICATIONS,INTERACTIONSORMEETINGSWITHOTHERSASARESULTOFYOURUSEOFTHESITE,DEVELOPERSERVICESORCOMMUNITIES,WHETHERSUCHLIABILITYARISESFROMANYCLAIMBASEDUPONCONTRACT,WARRANTY,TORT(INCLUDINGNEGLIGENCE),STRICTLIABILITYOROTHERWISE,ANDWHETHERORNOTUNITYORITSLICENSORSHAVEBEENADVISEDOFTHEPOSSIBILITYOFSUCHLOSSORDAMAGE.THEFOREGOINGLIMITATIONSWILLSURVIVEANDAPPLYEVENIFANYLIMITEDREMEDYSPECIFIEDINTHEAGREEMENTISFOUNDTOHAVEFAILEDOFITSESSENTIALPURPOSE.SOMEJURISDICTIONSDONOTALLOWTHELIMITATIONOREXCLUSIONOFLIABILITYFORINCIDENTALORCONSEQUENTIALDAMAGES,SOTHEABOVELIMITATIONOREXCLUSIONMAYNOTAPPLYTOYOU.11.CONTROLLINGLAWANDJURISDICTION11.1CHOICEOFLAW.TheAgreementisgovernedbyandconstruedinaccordancewiththelawsofDenmark,withoutregardtoorapplicationofconflictoflawsrulesorprinciples.TheUnitedNationsConventiononContractsfortheInternationalSaleofGoodswillnotapply.11.2ARBITRATION.ExceptassetforthbelowinSection9.3,anydisputearisingoutoforinconnectionwiththeAgreement,includinganydisputesregardingtheexistence,validityorterminationthereof,shallbesettledbyarbitration.ThepartiesagreetoarbitratealldisputesbysimplifiedarbitrationarrangedbyTheDanishInstituteofArbitrationinaccordancewiththerulesofsimplifiedarbitrationprocedureadoptedbyTheDanishInstituteofArbitrationandinforceatthetimewhensuchproceedingsarecommenced.Thepartiesfurtheragreethatanyarbitrationshallbeconductedintheirindividualcapacitiesonlyandnotasaclassactionorotherrepresentativeaction,andthepartiesexpresslywaivetheirrighttofileaclassactionorseekreliefonaclassbasis.YOUANDUNITYAGREETHATEACHMAYBRINGCLAIMSAGAINSTTHEOTHERONLYINYOURORITSINDIVIDUALCAPACITY,ANDNOTASAPLAINTIFFORCLASSMEMBERINANYPURPORTEDCLASSORREPRESENTATIVEPROCEEDING.Ifanycourtorarbitratordeterminesthattheclassactionwaiversetforthinthisparagraphisvoidorunenforceableforanyreasonorthatanarbitrationcanproceedonaclassbasis,thenthearbitrationprovisionsetforthaboveshallbedeemednullandvoidinitsentiretyandthepartiesshallbedeemedtohavenotagreedtoarbitratedisputes.11.3ARBITRATIONEXCEPTIONS.Notwithstandingtheparties’agreementtoresolvealldisputesthrougharbitration,eitherpartymaybringanactionincourt:(a)toenforceitsintellectualpropertyrights(“intellectualpropertyrights”meanspatents,copyrights,moralrights,trademarks,andtradesecrets,butnotprivacyorpublicityrights),includingwithoutlimitationtoseekinjunctiverelief;(b)incasesthatdonotinvolveintellectualpropertyrights,toseektemporary,preliminaryorotherexpeditedorprovisionalinjunctiverelief(butnotmoneydamages);or(c)collectfeesduepursuanttotheAgreement.Ifyoureside(oryourprincipalplaceofbusinessis)withintheUnitedStatesandthepartieshaveanintellectualpropertyrightsdispute,youandUnityagreetosubmittothepersonalandexclusivejurisdictionofandvenueinthestateandfederalcourtslocatedinSanFranciscoCounty,California.Ifyoureside(oryourprincipalplaceofbusinessis)outsideoftheUnitedStatesandthepartieshaveanintellectualpropertyrightsdispute,youandUnityagreetosubmittothepersonalandexclusivejurisdictionofandvenueinthecourtslocatedinCopenhagen,Denmark.Thepartiesagreetoacceptserviceofprocessbymail,andherebywaiveanyandalljurisdictionalandvenuedefensesotherwiseavailable.12.GENERALTheAgreementisthecompleteandexclusiveunderstandingandagreementbetweenthepartiesregardingitssubjectmatter,andsupersedesallproposals,understandingsorcommunicationsbetweentheparties,oralorwritten,regardingitssubjectmatter,unlessyouandUnityhaveexecutedaseparateagreementgoverningyouruseoftheSoftwareand/orDeveloperServices,inwhichcasesuchseparateagreement(s)willcontrolinrelationtotherelevantSoftwareand/orDeveloperServices.TheEnglishlanguageversionoftheAgreementislegallybindingincaseofanyinconsistenciesbetweentheEnglishversionandanytranslations.AnytermsorconditionscontainedinyourpurchaseorderorotherorderingdocumentthatareinconsistentwithorinadditiontothetermsandconditionsoftheAgreementareherebyrejectedbyUnityandwillbedeemednull.YoumaynotassignortransfertheAgreementoranyrightsgrantedhereunder,byoperationoflaworotherwise,withoutUnity’spriorwrittenconsent.Anyattemptbyyoutodoso,withoutsuchconsent,willbevoid.UnitymayassignortransfertheAgreement,atitssolediscretion,withoutrestriction.Subjecttotheforegoing,theAgreementwillbindandinuretothebenefitoftheparties,theirsuccessorsandpermittedassigns.ExceptasexpresslysetforthintheAgreement,theexercisebyeitherpartyofanyofitsremediesundertheAgreementwillbewithoutprejudicetoitsotherremediesundertheAgreementorotherwise.Unitywilldeliverallnotices,approvalsorothercommunicationsrequiredorpermittedundertheAgreement,includingthoseregardingmodificationstotheAgreement:(a)viae-mail(ineachcasetotheaddressthatyouprovide);or(ii)bypostingtotheSite,theServicePaneloryourUnityAccount.Fornoticesmadebye-mail,thedateofreceiptwillbedeemedthedateonwhichsuchnoticeistransmitted.ThefailurebyeitherpartytoenforceanyprovisionoftheAgreementwillnotconstituteawaiveroffutureenforcementofthatoranyotherprovision.Anywaiver,modificationoramendmentofanyprovisionoftheAgreementwillbeeffectiveonlyifinwritingandsignedbyauthorizedrepresentativesofbothparties.IfanyprovisionoftheAgreementisheldtobeunenforceableorinvalidthatprovisionwillbeenforcedtothemaximumextentpossibleandtheotherprovisionswillremaininfullforceandeffect.CONTACTINGUNITYIfyouhaveanyquestionsabouttheAgreement,pleasee-maillegal@unity3d.com.UNITYSOFTWAREADDITIONALTERMSLastupdated:June28,2016YouruseoftheUnitySoftwareissubjecttotheseAdditionalTerms(the“SoftwareTerms”),whichsupplementandincorporatetheUnityTermsofService.Bydownloading,installingorusingtheUnitySoftwareinanymanner,yourepresentandaffirmthatyouhaveread,understandandagreetobelegallyboundbyandcomplywiththeseSoftwareTerms.IfyoudonotagreewiththeseSof
